Summary

This position is located in the Office of the Legal Adviser (L).  As an Attorney-Advisor (International), the attorney will advise the Directorate of Defense Trade Controls (DDTC), an administrative agency within the Department that is responsible for implementing the International Traffic in Arms Regulations (ITAR). 

This position is in the Excepted Service and appointments are made without regard to the requirements of the Competitive Service by laws, Executive order, or OPM regulations.

Duties

Help

The attorney primarily advises the Bureau of Political-Military Affairs, Office of Directorate of Defense Trade Controls, (PM/DDTC), an administrative agency within the Department responsible for the International Traffic in Arms Regulations (ITAR). Work assignments may include:

  • Reviewing and helping to draft proposed rules and final regulations; developing corresponding guidelines, informational materials, and written opinions relating to the same; drafting replies to congressional inquiries; and advising on the Freedom of information Act.
  • Acting as a legal adviser to assigned client Bureaus and receives tasks and/or cases from the clients that includes authoring legal advisory opinions, legal memoranda, and substantive correspondence analyzing legal issues presented and their relationship to the Department's policies, programs, and objectives and coordinating review by other Department stakeholders and other federal agencies, as appropriate.
  • Keeping abreast of legal developments in area of responsibility, including court precedent and changes in law, regulation, and internal policies and procedures, and systematically applying knowledge as relevant to carrying out responsibilities.
  • Working with other government attorneys/officials which can include those in Congress, the Office of Management and Budget (OMB), the Department of Commerce’s Bureau of Industry and Security (BIS), various elements of the Department of Defense (DoD), of the Department of Justice (DoJ)  and at the National Security Council (NSC).
  • Providing objective, non-partisan, and analytically rigorous advice that balances the immediate interests of the client Bureau with the broader, longer-range interests of the Department of State and the foreign affairs of the U.S. government generally.
  • Counseling on matters this can include due process issues, administrative subpoenas, and settlement agreements.
  • Compiling administrative records and applying legal privileges and managing court-ordered discovery.
  • Reviewing agency and other attorneys’ draft briefs, memos, and other written work product to ensure legal accuracy and consistency with Department polices and interests.
  • At the GS-14 level, the incumbent performs the same duties as outlined above; however, the scope and complexity of assignments are increased and the incumbent receives closer supervision than the GS-15.

Law Degree: Applicants must be a graduate of an accredited law school with a J.D. or LL.M. Bar Membership.

Applicants must be a current member of a bar in good standing in any state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Applicants interested in GS- 14:

Experience: Applicants must have at least three years of specialized experience with at least one year equivalent to the GS-13 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position. The specialized experience must have been gained after admission to the bar.

Qualifying specialized experience must demonstrate the following: 

Examples of adequate “post licensure legal practice experience”, minimum 3-years, include: 

  • Experience working as a federal government lawyer, or equivalent in state or local government; OR as a licensed private sector lawyer; and
  • Experience working with senior attorneys in charge of providing legal counsel, legal written and verbal opinions/memoranda, and/or assisting with litigation (including discovery) and/or drafting and negotiating agreements; and
  • Experience in one or more areas of law as a practicing attorney in the following fields: global trade, litigation, providing regulatory guidance, compliance, investigations, administrative hearings, or legal review.

There is no substitute of education for specialized experience for the GS-14 position.

Applicants interested in GS- 15:

Experience: Applicants must have at least four years of specialized experience with at least one year equivalent to the GS-14 level in the Federal Service, which provided you with the particular knowledge, skills, and abilities to perform the duties of this position. The specialized experience must have been gained after admission to the bar.

Qualifying specialized experience must demonstrate the following: 

Examples of adequate “post licensure legal practice experience”, minimum 4-years, include: 

  • Experience working as a federal government lawyer, or equivalent in state or local government; OR as a licensed private sector lawyer; and
  • Experience providing legal counseling, legal written and verbal opinions/memoranda, and/or handling litigation (including discovery) and/or drafting and negotiating agreements; and 
  • Experience in one or more areas of law as a practicing attorney in the following fields: global trade, litigation, providing regulatory guidance, compliance, investigations, administrative hearings, or legal review.

There is no substitute of education for specialized experience for the GS-15 position.
