To ensure compliance with an applicable preliminary nationwide injunction, which may be supplemented, modified or vacated, depending on the course of ongoing litigation, the Federal Government will take no action to implement or enforce the COVID-19 vaccination requirement pursuant to Executive Order 14043 on Requiring Coronavirus Disease 2019 Vaccination for Federal Employees. This position is located in the Office of General Counsel of the Export-Import Bank of the United States (EXIM). The incumbent serves as an Assistant General Counsel (AGC) for the Administrative Law Group (ALG) providing leadership and management support to those teams of attorneys in the Division designated by the General Counsel or Deputy General Counsel. The incumbent, together with the other Assistant General Counsels and all other Lead Attorney-Advisors, will be part of the "senior staff" of the Division and will assist in the formulation and implementation of legal, policy and personnel practices and procedures for the attorneys and support staff of the Division.

At the full performance level, duties include, but are not limited to:

  • Supervises the legal and administrative aspects of OGC for the Administrative Law Group (ALG) and provides day-to-day management of unit attorneys including interns.
  • Performs legal work involving the following administrative areas and must be an expert in one or more of such areas: equal employment opportunity, labor relations and human resources/personnel matters and Federal employment law generally i.e. defending the Bank's decisions in adverse personnel actions; Freedom of Information Act; Trade Secrets Act and Privacy Act; procurement, contracting, leasing and property management matters; policy administration; suspension and debarment (procurement and non-procurement matters); appropriations and fiscal law that involve large dollar amounts with impact to the Bank's budget, which in turn impacts the Bank's ability to execute its assigned mission; Federal Constitutional law; investigations; litigation support (in cooperation with the Department of Justice and private law firms, Touhy requests); the Government in Sunshine Act; the Paperwork Reduction Act; statutory interpretation; Federal Government ethics; national security issues; and miscellaneous administrative law matters requiring interpretation of federal laws and regulations affecting the Bank.
  • Undertakes complex special assignments of importance to EXIM as designated by the General Counsel and the Deputy General Counsel, to develop policy options for consideration, address unusual and novel questions of legal interpretation, and propose innovative resolutions to issues affecting the agency. Advises management and policy-makers in multiple aspects of administrative law issues.
  • Represents the agency in administrative litigation, and provide related legal opinions and advice based on established legal precedent to officials in OGC and throughout the Bank to resolve complex administrative and judicial litigation. The incumbent also represents the Bank in its capacity as employer in appeals before administrative agencies such as the Equal Employment Opportunity Commission (EEOC), the Merit Systems Protection Board (MSPB), and arbitrators, which can have significant impacts on the Bank's administrative budget.
  • Provides legal review for all outgoing FOIA requests, advise on the statute and regulations and directly adjudicate, review, and/or direct other employees in the adjudication of Freedom of information Act appeals, which can delay or prevent the Bank from executing its assigned mission.
  • Serves as a subject matter expert with respect to legal review of the Bank's administrative policies, including drafting and editing new and updated policies.
  • Coordinates responses to Congressional requests for information, including providing advice based on statues and other established precedent on withholding redacted portions of materials containing business confidential and deliberative information.

Specialized Experience (Credit for Specialized Experience on resume must reflect 40 hours/Full-time per week for each period of work):

GS-15: You must have one (1) year of specialized experience that has equipped you with the particular knowledge, skills, and abilities to successfully perform the duties of the position, and that is typically in or related to the work of the position to be filled. To be creditable, specialized experience must have been equivalent to at least the GS-14 level in the Federal Government. Specialized experience includes:
  • Experience in providing direction to, and management of the performance of the attorneys, paralegals, and other personnel in an Administration Law Group (ALG) of an Office of General Counsel (OGC), or the equivalent in a private law firm.
  • Experience in the recruitment and hiring of attorneys, paralegals, interns, and support staff.
  • Experience in providing legal oversight and technical guidance in connection with Freedom of Information Act (FOIA), Trade Secrets Act (TSA), Privacy Act, and related statute, regulations, and administrative/regulatory matters.; AND
  • Experience in providing legal guidance and litigation support in all aspects of personnel matters, including under the Equal Employment Opportunity Act.

Education cannot be substituted for experience at the GS-15 grade level.
