Help

The Division of Examinations' mission is to protect investors, ensure market integrity and support responsible capital formation through risk-focused strategies that: (1) improve compliance; (2) prevent fraud; (3) monitor risk; and (4) inform policy. The results of the Division's examinations are used by the SEC to inform rule-making initiatives, identify and monitor risks, improve industry practices and pursue misconduct.

If selected, you will join a well-respected team that is primary responsibility for oversight and technology examinations of self-regulatory organizations as well as for broker-dealers and investment advisers.

As a Supervisory Attorney-Adviser you will be:

  • Supervise and manage staff within the Branch including providing administrative and technical supervision necessary for accomplishing the work of the unit;
  • Perform IT security audits at SROs, broker-dealers, or investment advisers, conduct assessments of the IT architecture; and prepare written reports of findings;
  • Plan and conduct analyses of securities exchange operational practices and requirements to evaluate securities industry computer systems requirements and to improve self-regulatory organizations' response to market activity;
  • Develop policies, guidelines, and standards for the planning, development, integration, implementation, and evaluation of information technology systems and subsystems that meet overall information needs of multiple major organizational units;
  • Provide expert advice and guidance on broad projects and programs with national impact related to the SEC's Technology Controls program;
  • Provide authoritative guidance related to the securities industry IT security program; and
  • Develop long-range plans for IT security systems that anticipate, identify, evaluate, mitigate, and minimize risks associated with IT systems vulnerabilities.

  • SUPERVISORY TRIAL PERIOD: This appointment may require completion of a supervisory two-year trial period.
  • SECURITY CLEARANCE: Entrance on duty is contingent upon completion of a pre-employment security investigation. Favorable results on a Background Investigation may be a condition of employment or selection to another position.
  • DRUG TESTING: This position may be subjected to drug testing requirements.
  • PERMANENT CHANGE OF STATION (PCS): Moving/Relocation expenses are not authorized.
  • DIRECT DEPOSIT: All Federal employees are required to have Federal salary payments made by direct deposit to a financial institution of their choosing.
  • This position is not in the collective bargaining unit.
  • Due to COVID-19, the SEC is currently in an optional telework posture. This position is eligible to request telework in accordance with the SEC 's telework policy.
  • Typical Examiner Travel: Examination staff routinely travel to the offices of registered entities to conduct on-site inspections of facilities, to meet with and interview entity personnel, and to examine certain business records.

Qualifications

All qualification requirements must be met by the closing date of this announcement.

Qualifying experience may be obtained in the private or public sector. Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience. Qualifying education must have been obtained from an accredited college or university recognized by the U.S. Department of Education.

BASIC REQUIREMENT: All applicants must possess the following

  • J.D. or LL.B. degree --AND--
  • Active membership of the bar in good standing in any state, territory of the United States, the District of Columbia, or the commonwealth of Puerto Rico. (Note: proof of bar membership will be required before entry on duty.

MINIMUM QUALIFICATION REQUIREMENT: In addition to meeting the basic requirement, applicants must also meet the minimum qualification requirement.

SK-15: Applicant must have three years of post J.D. experience identifying legal issues, providing legal analyses, providing legal solutions/recommendations, and preparing legal documents, such as contracts, dispositions, pleadings, and motions, which also includes at least two years of:
  1. Providing legal advice on issues related to the rules and policies of Federal securities laws and acts relating to self-regulatory exchanges, broker-dealers, or investment advisers; AND
  2. Developing recommendations and/or reports of findings while interacting with executive management, co-workers, and members of the securities industry to resolve issues; AND
  3. Conducting briefings for management and/or representing the organization at briefings and meetings with other divisions or government agencies or speaking at conferences; AND
  4. Leading a team that is responsible for deploying, supporting, or auditing technology solutions employed in the securities markets;
  5. AND at least one of the following:
    • Developing and preparing guidance on a variety of legal issues arising from interpretation and application of federal securities laws, rules and regulations with little or no supervision; OR
    • Serving as an adviser to management concerning systems, networks, and software designs for potential security risks.
