Duties

Help

At the entry level of this position, you will:

  • Receive and review referrals of potential Suspension and Debarment (S&D) actions from EPA officials, other federal departments and agencies, and state and local governments to determine and propose appropriate legal action necessary to protect the public interest and maintain compliance with the integrity of EPA programs
  • Work with senior Debarment Counsel on case strategy development and execution, and depending on the type of proceeding, preparing opening and closing arguments, direct- and cross-examination of witnesses, questioning the targets of S&D actions (Respondents), drafting written responses, and making recommendations to the Suspension and Debarment Official (SDO) based on an analysis of the full administrative record
  • Negotiate and draft Administrative Agreements (AAs) with Respondents for endorsement by the SDO, ensuring that all EPA and other federal interests are addressed and protected

Current Bar membership in good standing/law license is required. You must self-certify annually and in writing that you hold an active bar membership.

If you are selected, you will be required to complete a Confidential Financial Disclosure form within 30 days of your first day of employment and annually thereafter.

This position is designated as High Risk and requires a background investigation. Unless an appropriate background investigation is already on record with the Office of Personnel Management, you must undergo a background investigation. All conditions of the pre-employment security process must be met before an official letter of employment can be issued with a report for duty date.

If you are selected, you may be required to complete a one-year trial period.

Qualifications

You must be admitted to practice before the highest court of a state, U.S. territory, the District of Columbia, or the Commonwealth of Puerto Rico; and must maintain active status as a member of the bar of one of these jurisdictions.

In addition, the following specialized training or experience is desired:

  • Understanding and applying complex statutory and regulatory requirements and procedures; to digest, synthesize, and summarize complex and lengthy administrative records, hearing transcripts and briefs or similar materials; to resolve difficult and often novel factual and legal issues in accordance with applicable statutory, procedural and other legal requirements or precedents; and to communicate effectively complex factual and legal issues orally and in writing.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional, philanthropic, religious, spiritual, community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.
