Organizational Location: This position is with the Department of Homeland Security, within U.S. Customs and Border Protection, Office of Trade, Regulations and Rulings, Regulations and Disclosure Law Division, Border Security Regulations Branch located in Washington, DC.

This position serves as the Branch Chief within DHS, CBP, Office of Trade (OT), Regulations and Rulings (RR), Regulations and Disclosure Law Division, Border Security Regulations Branch. This position starts at a salary of $142,701.00 (GS-15, Step 1) to $170,800.00 (GS-15, Step 10) with promotion potential to $170,800.00 (GS-15 Step 10).

Typical work assignments include:

  • Supervising Attorney-Advisors, Paralegals and other support staff of the Border Security Regulations Branch;
  • Assigning cases/projects and reviewing regulations and notices prepared for the Federal Register and other written material prior to their issuance;
  • Providing technical legal/policy advice and guidance on matters covered by the branch to the Office of Field Operations (OFO) and other CBP offices, DHS, other agency representatives, the Department of the Treasury, and Congress; and
  • Maintaining all DHS and GSA/OMB regulatory databases which includes the Semi-annual Unified Agenda and the Unified Agenda containing CBP's current administrative rulemakings.

Qualifications

Education Requirement: You must provide supporting documentation in your application to show you meet the education requirement below:

A.Completion of the first professional law degree (LL.B. or JD); or completion of the second professional law degree (LL.M.).

You qualify for this position if you meet the basic and education requirements listed above and possess three (3) years of specialized experience as described below:

Experience: You qualify for the GS-15 grade level if you possess 3 years of specialized experience equivalent to at least the next lower grade level, performing duties such as:

  • Drafting and interpreting legal instruments and working on other projects such as litigation, proposed legislation and training especially as it relates to the border security and trade missions of CBP;
  • Furnishing technical legal, administrative, and programmatic guidance and advice with respect to complex programs and/or Administrative Procedure Act (APA) rulemaking;
  • Providing guidance on complex program issues requiring extensive interpretation for various and unrelated program processes and methods; and/or
  • Reviewing regulations, proposed rulings and decisions, or other work to ensure legal accuracy and technical adequacy, and analyzing border security and trade policy implications and the decisions' effects on uniformity.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

You must:
  • Meet all qualification requirements, including education if applicable to this position, subject to verification at any stage of the application process.
The Office of Personnel Management (OPM) must authorize employment offers made to current or former political appointees. Residency: There is a residency requirement for all applicants not currently employed by CBP. Individuals are required to have physically resided in the United States or its protectorates (as declared under international law) for at least three of the last five years. If you do not meet the residency requirement and you have been physically located in a foreign location for more than two of the last five years, you may request an exception to determine if you are eligible for a residency wavier by meeting one or more of the following conditions:
  • Working for the U.S. Government as a federal civilian or as a member of the military
  • A dependent who was authorized to accompany a federal civilian or member of the military who was working for the U.S. government
  • Participation in a study abroad program sponsored by a U.S. affiliated college or university
  • Working as a contractor, intern, consultant or volunteer supporting the U.S. government
Trial Period: You may be required to serve a trial period of two years.

Supervisory Probationary Period: You may be required to serve an 18 month probationary period upon appointment and complete a supervisory training course within 12 months of assignment.

Supervisory Training: All newly appointed first-time GS-15 Supervisors are required to complete mandatory training. The training will be scheduled by the Office of Training and Development within the first 90 days of appointment. The duration of the training will include (CBP LI five (5) weeks) in residence training in Harpers Ferry, WV. Note: This training may be waived if previously completed.

  • Knowledge of reviewing regulations, rulings, decisions or other work of Regulations and Rulings (RR) to ensure legal accuracy, technical adequacy, and uniformity, as well as coordinating with other branches in RR, the Office of Chief Counsel, other CBP offices such as the Office of Field Operations, DHS and other government agencies on projects and other matters as appropriate;
  • Skill in drafting, interpreting or applying legislation, regulations, contracts, orders, decisions, rulings, opinions or other legal instruments involving extremely complex and difficult legal questions;
  • Ability to efficiently manage employee performance, the flow of work while maintaining the high quality of the final work product, and skill in setting goals and establishing plans;
  • Skill in oral and written communication including developing and maintaining relationships with stakeholders in order to accomplish CBP and DHS goals, including lawful travel, border/trade security (e.g., CTPAT, trusted trader) and expansion of ports of entry; and
  • Skill in leading, managing and consulting on programs and processes in the areas of legal policy and regulations.
