The incumbent will serve as Chief Counsel to the PRAC. The incumbent works under the direction of the Executive Director (ED) and reports directly to the Deputy Executive Director (DED). As Chief Counsel, the incumbent will be responsible for providing expert legal counsel to the ED, the DED, the Associate Directors, and PRAC leadership to develop and carry out programs mandated by the CARES Act.
The chief counsel manages the substantial workload performed by the PRAC legal staff in coordination with the CIGIE legal staff and is fully accountable for ensuring a successful legal program that supports the PRAC's mission.
Must be an active member in good standing of a state or D.C. bar.
Must successfully obtain and maintain a secret clearance.
To meet the minimum qualifications for this position, candidates must possess specialized experience at a senior level which demonstrates ability to perform the duties described below, including progressively responsible supervisory or managerial experience demonstrating ability to manage people and resources.
The chief counsel manages the substantial workload performed by the PRAC legal staff in coordination with the CIGIE legal staff and is fully accountable for ensuring a successful legal program that supports the PRAC's mission.
More specifically the incumbent:
a. Provides the full range of professional legal services and advice with respect to the formulation, coordination, and execution of the PRAC's transparency, oversight, and accountability functions. Provides expert legal counsel to the ED and all other PRAC officials in all legal matters involving the PRAC whether criminal, civil, or administrative.
b. Directs in accordance with the requirements and provisions of the CARES Act and Inspector General Act of 1978, the PRAC legal review of all proposed legislation and regulations affecting pandemic programs and activities for the purpose of determining the potential policy and programmatic impact of such measures on the economic, efficient, and effective administration of PRAC activities, as well as their potential for preventing or detecting fraud and abuse.
c. Reviews and analyzes all Agency internal program policies. Responsible for interpretations and evaluations, often without legal precedent.
d. Provides sensitive liaison with high-level policymaking and program officials of CIGIE, OIGs, PRAC leadership, the Department of Justice (DOJ), other law enforcement agencies, and Congress. The incumbent consults with, and may seek opinions from, the CIGIE legal staff of interpretations of statutes which govern the programs and operations of the Agency other than the PRAC, and on significant issues that may impact substantially on Agency operations.
e. Represents the PRAC, at the request of the ED, before the Department of Justice, state and local governments, and other organizations.
f. Directs the activities of the legal staff including: (1) the development of legal opinions, briefs, pleadings, speeches, memoranda, etc. on important and significant litigation matters and on vital policy matters; (2) the review of PRAC reports and issues for legal sufficiency and potential legal issues; and (3) the provision of litigation support services to DOJ.
g. Provides assistance to U.S. Attorneys and DOJ attorneys in the preparation and conduct of criminal and civil proceedings.
h. In collaboration with CIGIE legal staff, directs the coordination and evaluation of all requests submitted to the PRAC under the provisions of the Freedom of Information and Privacy Acts.
i. Serves as the advisor for legal sufficiency for all Memoranda of Understanding (MOU's) between the PRAC and internal/external entities.
Managerial responsibilities include selection of employees, assignment of duties, evaluation of employee performance, planning of employee training, and recommendation of awards, promotions, discipline, and adverse actions, and supports workplace diversity, workplace inclusion, and equal employment policies and programs.
Must hold a J.D. degree from an accredited law school.
