Duties

Help

The incumbent is responsible for administering and implementing the FOIA/PA for all component the Branch of Document Management and the supported regional offices. As an expert of the FOIA, Privacy Act (PA), and DOL regulations, interprets court decisions and uses legal research to find applicable decisions on resolving the problems at hand.

The incumbent implements public information regulations and knowledge of the FOIA and the PA and related regulations and actively participates in the administration of the FOIA program Division activities.

Works with program offices to ensure adequate search, for reviewing and redacting responsive documents for production or, when directed, for coordinating review of documents by other FOIA specialists and for assuring timeliness and quality of production.

Assures that requests are thoroughly analyzed, that decision to release or deny materials are soundly based on law and policy, and that all involved parties/requesters, legal representatives, SOL, agency personnel and supervisors are properly and thoroughly appraised of actions, decisions, and possible ramifications of release or withholdings of information.

Handles correspondence and questions from other individuals concerning the implementation of the FOIA within WHD. Conduct liaison activities with FOIA offices in DOL and other agencies on such matters as responding to overlapping requests.

Independently reviews documents to determine whether they are subject to withholding under the FOIA.

Researches, and applies a wide range of qualitative and/or quantitative methods to identify, assess, analyze and improve effectiveness and efficiency of existing litigation prevention strategies and devises new ones if needed.

Qualifications

Applicants must demonstrate in their resume, 52 weeks of specialized experience equivalent to at least the next lower grade level, GS-12, in the Federal Service that is typically in or related to the position being advertised.

Examples of specialized experience are:

1. Experience in providing advice and guidance on the provisions of the FOIA and PA, and court cases decided under its authority, and on DOL regulations implementing the Acts, in order to respond to inquiries regarding Departmental procedures and regulations, coordinate the Branch's compliance with the FOIA, and to provide expert advice and guidance to the Division and other program’s office staff.

2. Experience in interpreting court decisions and using legal research to find applicable decisions and to provide expert advice and guidance to individuals at all levels, in order to represent the Agency in legal discussions and to serve as a FOIA authority for the agency.

3. Experience in communicating and advising officials on significant public affairs aspects as they relate to policy and programs governing the disclosure of confidentiality of information.

There is no educational substitution for specialized experience at this grade level.
