Summary

Employment with the USAO offers a unique and challenging experience for the highly motivated attorney: an opportunity to litigate a broad range of cases involving significant and complex issues on behalf of the United States in federal court. Working in the Civil Division, you will be part of a dedicated team representing the United States and federal agencies in a variety of cases, including, employment, tort, constitutional, FOIA, Administrative Procedure Act, and False Claims Act cases.

Several permanent AUSA positions will be filled. In addition, positions of a limited term, not to exceed 2 years, are available and will be filled. TERM-limited positions may be extended and may be converted to permanent position without further competition. On your cover letter, please indicate the type of appointment(s) you would like to be considered for (permanent, term-limited or both).

There are offices in San Francisco; Oakland; and San Jose, California. Therefore, please state your location preference on your cover letter (SF, Oak, SJ).

This announcement opens May 1, 2020 and closes on December 31, 2020. Applications will be reviewed on a rolling basis. Applicants will hear from the office within 90 days of submitting an application.

Responsibilities will increase and assignments will become more complex as your training and experience progress.

Qualifications


Required Qualifications:
Applicants must possess a J.D. Degree, be an active member of the bar (any U.S. jurisdiction), and have at least three (3) years of experience as a licensed attorney (or post-law school graduation judicial clerkships) preparing for, participating in, and/or reviewing formal hearings or trials involving litigation at the federal, state, or local court level.

Applicants must be licensed to practice law in any state, U.S. Territory or the District of Columbia. Applicants must be active members in good standing of the bar (any jurisdiction).

The U.S. Attorney's Office considers California Rule 1-7 to be implicated when an attorney licensed in California applies for a position with the U.S. Attorney's office while also representing a client in litigation opposing the U.S. or knowingly under investigation by the U.S.

United States citizenship is required.

Salary Information: Assistant United States Attorney's pay is administratively determined based, in part, on the number of years of professional attorney experience. The range of basic pay is $83,892 to $170,700. which includes 41.44% locality pay.

Type of Position: All initial attorney appointments to the Department of Justice are made on a 14 month (temporary) basis pending favorable adjudication of a background investigation.

Residency Requirements: Assistant United States Attorneys generally must reside in the district to which they are appointed or within 25 miles thereof. See 28 U.S.C. 545 for district-specific information.
Residency Requirement. The Residency Requirement ensure an adequate background investigation can be completed. It applies to all DOJ applicants, both U.S. citizens and non-U.S. citizens, whose job location is within the U.S. In addition, for a total of three years (not necessarily consecutive years) of the five years immediately prior to applying for a position, the applicant must have: 1) resided in the U.S.; 2) worked for the U.S. overseas in a Federal or military capacity; or, 3) been a dependent of a Federal or military employee serving overseas.Examples of exceptions are:- Applicant's spouse worked for the U.S. overseas in a Federal or military capacity; or- Applicant's employment was in the Peace Corps; or- Applicant has a background investigation that was completed within the last 5-years

How you will be evaluated

You will be evaluated for this job based on how well you meet the qualifications above.

Evaluation Method: Once your complete application package is received, it will be reviewed to ensure you meet all job requirements. An attorney interview panel will then review all qualified applicants and make recommendations for invitation to interview. You will be notified if selected for an interview.

The Occupational Questionnaire will take you approximately 20 minutes to complete.

Veterans' Preference: There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Justice considers veterans' preference eligibility as a positive factor in attorney hiring. Applicants eligible for veterans' preference must indicate their preference in response to the appropriate question in their assessment questionnaire (it is also recommended that information is included in their cover letter or resume) and they must submit supporting documentation (e.g., DD 214, Certificate of Release or Discharge from Active Duty and other supporting documentation) which verifies their eligibility for preference. Although the "point" system is not used, per se, applicants eligible to claim 10-point preference must submit Standard Form (SF) 15, Application for 10-Point Veteran Preference, and submit the supporting documentation required for the specific type of preference claimed (visit the OPM website, http://www.opm.gov/forms/pdf_fill/sf15.pdf for a copy of SF 15, which lists the types of 10-point preferences and the required supporting document(s). Applicants should note that SF 15 requires supporting documentation associated with service-connected disabilities or receipt of nonservice-connected disability pensions to be dated 1991 or later except in the case of service members submitting official statements or retirement orders from a branch of the Armed Forces showing that his or her retirement was due to a permanent service-connected disability or that he/she was transferred to the permanent disability retired list (the statement or retirement orders must indicate that the disability is 10% or more).
