As an Attorney-Advisor with the Department of the Interior, Office of the Solicitor, Division of General Law, Employment and Labor Law Unit your specific duties will include:
Serving as a trial attorney and legal advisor handling federal sector employment litigation, policy and counseling matters, including human resources, employment discrimination and labor relations issues.
Advising senior Departmental and Bureau officials on federal employment litigation and policy, including Title 5 of the United States Code, Title VII of the Civil Rights Act, the Age Discrimination in Employment Act, the Rehabilitation Act, the Equal Pay Act, the Americans with Disabilities Act, labor relations pursuant to Title VII of the Civil Service Reform Act, and various executive orders and regulations pertaining to employment actions, including discrimination and labor relations as they relate to federal employment, and relevant civil rights statutes falling under the Department's public civil rights programs.
Representing the agency in litigation before the Merit Systems Protection Board, Equal Employment Opportunity Commission, Federal Labor Relations Authority, the Federal Service Impasses Panel, arbitrators, and grievance examiners. Taking and defending depositions and eliciting testimony at trial.
Providing superior oral advocacy at hearings and well organized and well researched written products under tight deadlines.
Comprehensively researching novel areas of law and providing legal memoranda as requested by clients.
Working closely with and assisting Justice Department attorneys to represent the DOI in federal civil litigation involving discrimination and other employment related claims. Working closely with clients from the Department's Office of Civil Rights, the Director of Human Resources, Bureau human resources, labor relations and EEO offices, and senior Departmental management officials.
Are There Any Special Requirements For This Position?
In order to better assess your qualifications for this position, when preparing your resume please address your experience in or familiarity with the following subject matter areas and legal authorities: Federal public sector employment antidiscrimination laws, e.g., Title VII, the Rehabilitation Act, ADEA, VEOA, USERRA, WPEA, as well as disciplinary actions under Title V, union issues/litigation under the Federal Service Labor Management Relations Act, and counseling federal supervisors and managers on the above matters, as well as litigating those matters before the Equal Emp Employment Opportunity Commission (EEOC), Merit System Protection Board (MSPB), and Federal Labor Relations Authority (FLRA). In addition, please address your experience in or familiarity with the following areas of legal work: researching and writing legal memoranda and opinions, and providing legal advice or recommendations to clients, judges, and/or senior attorneys; litigating in Federal court and preparing litigation documents as needed; evidentiary privileges and ediscovery, including familiarity with technology associated with the electronic search, retrieval, and review of documents.
Experience as a judicial law clerk, a litigating attorney, and/or practicing in the areas of employment and/or labor law is desired but not mandatory.
Basic Qualification Requirements
Applicants must be law school graduates with LL.B. or J.D. degrees AND applicants must be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.
Applicants must also meet one of the following:
--possess at least 1-year of professional legal experience following law school graduation; OR
--have a second professional law degree; OR
--meet any of the criteria indicated below:
(a) academic standing in top one-third of law school graduating class;
(b) graduation with academic honors;
(c) significant participation on the law school’s law review;
(d) significant participation in the law school’s moot court competition;
(e) significant participation in a clinical legal aid program;
(f) significant summer law office clerk experience; or
(g) other equivalent evidence of clearly superior achievement.
GS-12/13/14:
In addition to meeting the basic qualification requirements described above, applicants must also have the following additional years of professional legal experience for the grade level indicated:
--GS-12 = 1 year
--GS-13 = 2 years
--GS-14 = 3 ½ years
