What General Information Do I Need To Know About This Position?

This position will serve in a critical role as a legal adviser within the Dept of the Interior.  This position serves as a liaison among the Bureau of Indian Affairs (BIA), the Office of the Special Trustee for American Indians (OST), the Office of Hearings and Appeals (OHA), and other Offices as necessary, regarding implementation and interpretation of both general probate and AIPRA issues.

As an Attorney-Adviser with the Department of the Interior, Office of the Solicitor, Division of Indian Affairs, Branch of Trust Services, located in Washington, DC your specific duties will include:

Responsibilities include drafting, reviewing, interpreting, and commenting on relevant statutes, proposed legislation, proposed amendments to relevant legislation, handbooks, memoranda, policy papers, presentations, training materials, regulations, and correspondence.

Providing legal advice to the client nationwide on Indian Land Consolidation Act (ILCA), American Indian Probate Reform Act of 2004 (AIPRA) the interpretation of probate orders, the probate appeals process, and a variety of miscellaneous issues arising from questions from heirs and other interested parties, including other federal agencies, Indian tribes, and Tribal organizations.

Serve as a member of the AIPRA Implementation Team, which trains and assists BIA staff on the DOI's responsibilities pursuant to AIPRA. The attorney will function as a liaison between the BIA, the OST, the OHA, and other DOI offices regarding implementation and interpretation of both general probate and AIPRA issues.

May be involved in administrative and judicial litigation involving probate issues, including legal research, drafting pleadings, and initiating and responding to discovery.

Assist Indian Tribes that are interested in creating and adopting Tribal Probate Codes by working closely with BIA officials and Tribal attorneys to review and provide comments to draft Tribal Probate Codes, as well as possible amendments to existing Tribal Probate Codes, ensuring that the draft Tribal Probate Codes do not violate federal law; and shepherding the draft Tribal Probate Codes through the official approval process.

Qualifications

Basic Qualification Requirements
Applicants must be law school graduates with LL.B. or J.D. degrees AND applicants must be an active member in good standing of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico bar.

Applicants must also meet one of the following:
--possess at least 1-year of professional legal experience following law school graduation; OR
--have a second professional law degree; OR
--meet any of the criteria indicated below:
(a) academic standing in top one-third of law school graduating class;
(b) graduation with academic honors;
(c) significant participation on the law school’s law review;
(d) significant participation in the law school’s moot court competition;
(e) significant participation in a clinical legal aid program;
(f) significant summer law office clerk experience; or
(g) other equivalent evidence of clearly superior achievement.

GS-13/14:
In addition to meeting the basic qualification requirements described above, applicants must also have the following additional years of professional legal experience for the grade level indicated:

--GS-13 = 2 years
--GS-14 = 3 ½ years

Candidates should be a proficient communicator with strong collaborative skills and writing abilities, with the capacity to analyze complex statutes and fact.
