Duties

Help

  • Performs basic factual analysis and research of pertinent facts, applicable law and established policy relating to petitions practice.
  • Prepares decisions for review and signature on petitions, ensuring all requirements of the pertinent patent laws, regulations, and policies have been satisfied.
  • Assists internal and external USPTO customers on petitions-related matters on the Petitions Help Desk.
  • Performs special projects as assigned by supervisor.

Specialized Experience: is experience that has equipped you with the particular knowledge, skills and abilities to perform successfully the duties of the position, and that is typically in or related to the position to be filled. To be creditable, specialized experience must have been equivalent to at least the next lower grade level.

Candidates for the GS-09 grade level must have at least 52 weeks of specialized experience equivalent to the next lower GS-07 grade level in the Federal service.

You must meet all qualification requirements including time-in-grade (refer to 5 CFR 300.604 for more information on time-in-grade) by the closing date of the job announcement.

Specialized experience for this position includes: Prepare factual analysis and research on problematic and difficult petitions. Analyze and prepare reports on complex pertinent statues, court decisions, legal opinions, and other legal documents; examining petition applications that required resolving conflicting data and interpreting rules, regulations and policies; Reviews and organizes complex factual material using methods of legal research and reference sources.

Substitution of education for experience: The experience requirements for the GS-09 may be met with a Master's or equivalent graduate degree or 2 Full years of graduate level education or LL.B. or J.D.in a field which demonstrates the knowledge, skills, and abilities necessary to do the work of the position, such as Law, Paralegal Studies, Legal Studies or other related discipline.

Combination of Education and Experience: A combination of education and experience may be used to qualify for this position as long as the computed percentage of the requirements is at least 100%. To compute the percentage of the requirements, divide your total months of experience by 12. Then divide the total number of completed graduate semester hours (or equivalent) beyond the first year (total graduate semester hours minus 18) by 18. Add the two percentages.

Experience refers to paid and unpaid experience, including volunteer work done through National Service programs (e.g., Peace Corps, AmeriCorps) and other organizations (e.g., professional; philanthropic; religious; spiritual; community, student, social). Volunteer work helps build critical competencies, knowledge, and skills and can provide valuable training and experience that translates directly to paid employment. You will receive credit for all qualifying experience, including volunteer experience.

Special Instructions for Foreign Education: Qualifying education from colleges and universities in foreign countries must be evaluated in terms of equivalency to that acquired in U.S. colleges and universities. A listing of these accredited organizations can be found on the Department of Education's website – US Department of Education. Another listing of services that can perform this evaluation is available at the National Association of Credential Evaluation Services (NACES) website. You must provide a copy of the letter containing the results of the equivalency evaluation with a course by course listing along with your application. Failure to provide such documentation when requested will result in lost consideration.

Probationary Period- If selected, you may be required to complete an initial one-year probationary period.

Relocation Expenses are not authorized and will not be paid.

CTAP candidates will be eligible for selection priority if it is determined that they have exceeded the minimum qualifications for the position by attaining at least a "well qualified" rating of 85 out of 100. KSA 1. Knowledge of patent information sources and USPTO office procedures sufficient to perform independently recurring assignments which are typically covered by established precedents.

KSA 2. Knowledge of patent examining guides, such as the Rules of Practice and Patent Laws, and the Manual of Patent Examining Procedures (MPEP) sufficient to locate factual information through use of their indices.

KSA 3. Ability to analyze petitions and legal precedents in order to apply general principles of law and draft decisions.

KSA 4. Ability to communicate factual information both orally and in writing.
