The Director of the Appellate Staff, Civil Division, is a Senior Executive Service position within the U.S. Department of Justice. The Appellate Staff is principally responsible for the appellate work of the Civil Division, covering a wide range of procedural and substantive issues. The incumbent oversees all aspects of the litigation and administrative functions of the Staff, develops policy for the Staff, and supervises both attorney and support positions. The office's caseload involves some of the most important, complicated cases over which the Civil Division has jurisdiction in the federal courts of appeals, and before the U.S. Supreme Court when assigned by the Solicitor General. The Staff's cases typically involve questions of great national interest, including cases with foreign policy or national security implications, and are of utmost importance to the conduct of the Government's business. In many cases, they are cases with potential monetary ramifications for the Government in the millions of dollars. The incumbent serves as the primary career appellate litigation specialist in the Civil Division, with responsibility for the most difficult, precedent-setting or sensitive cases. The Director also provides expert advice and counsel to the Deputy Assistant Attorney General and the Assistant Attorney General on litigation strategy, precedents, and mission impact.

As Director, Appellate Staff, the incumbent is responsible for management of the Appellate Staff with assistance from Deputy Directors and other managers. Establishes office policy, resolves employee complaints, takes action on disciplinary matters, identifies training needs and develops performance standards. Assigns work among attorneys, reviews and approves briefs and other papers filed with the courts, and counsels attorneys concerning approaches and strategies to be followed in preparing for or presenting a case. Provides guidance on all aspects of work performance. Advises staff on new programs or directives and ensures that adequate resources will be available for implementation. Evaluates organizational structures and makes changes based on new caseload requirements or policy directives. Analyzes proposed and pending legislation which may affect the work of staff or which is in any way related to its responsibilities, through Deputy and Assistant Directors. Makes recommendations to revise, support, or oppose such legislation and assists in formulating the Department/Division's position. Represents the Assistant Attorney General and Deputy Assistant Attorney General to the officials and judges of the Courts of Appeals in connection with all matters relating to the Staff and the Division's business with the courts. Also represents the Division on various inter-departmental committees or activities with respect to related matters and in dealings with counsel for litigants or others, including, as appropriate, congressional staff representatives, the media, and the public. Maintains close contact with Civil Division attorneys and responsible officials of the agencies that are involved in appellate matters in order to consult with them on special problems which may arise. Directs Division staff and agency officials in the development of the appellate litigation strategy, including the preparation of the legal arguments, marshaling of factual material, etc. Counsels agencies as appropriate on agency procedures and policies which are affected by court decisions. Advises and consults with the Deputy Assistant Attorney General and the Assistant Attorney General on appellate matters. Formulates and presents new policies or organizational changes affecting the operations of the Staff. Advises on significant cases and their impact/ramifications concerning the staff, the Branches and the Division.

The Executive Core Qualifications (ECQs)of the selectee who is not a current or former career Senior Executive employee (Title V) must be approved by the Office of Personnel Management (OPM) before appointment. In addition, individuals entering the Senior Executive Service for the first time are subject to a one-year probationary period.

Education must be accredited by an accrediting institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications. Therefore, provide only the attendance and/or degrees from schools accredited by accrediting institutions recognized by the U.S. Department of Education.
