The position is located in the Department of Defense Office of Inspector General (DoD OIG). The Inspector General (IG) reports to the Secretary of Defense and the Congress. The DoD OIG has responsibility to detect and deter fraud, waste, and abuse, and promote the economy and efficiency of DoD Programs and operations, in accordance with the Inspector General Act of 1978, P.L. 95-452, as amended.

Help

The General Counsel of the Department of Defense Office of Inspector General (DoD OIG) serves as the chief legal officer of the Office of Inspector General and provides oversight, guidance, and direction regarding OIG legal matters.

The incumbent regularly renders definitive legal opinions on policy matters concerning the DoD Inspector General (IG) requiring the DoD IG's personal attention. A substantial number of these opinions are on matters of the greatest significance, requiring policy decisions by the Secretary of Defense and/or referral to the President.

Participates in major planning and policy deliberations at top levels within the OIG. The incumbent analyzes the plans and procedures presented for consideration and participates in debates and discussions regarding the merits of proposals, and their impact on DoD programs. The incumbent calls attention to legal requirements that must be met or that would limit or prohibit a proposed action.

Assists in preparing the IG and other senior officials to testify before Congressional committees.

The incumbent reviews for the DoD the entire DoD Legislative Program, with direct responsibility for initiating action to establish and present the views of the DoD IG and provide the basis for integration of the Legislative Program with recommendations made by the DoD IG.

The incumbent renders advice and legal opinions on matters that have an impact on virtually all substantive and operational programs of the Department of Defense, inasmuch as the recommendations of the DoD IG directly or indirectly influence the nature, scope, and methods of conducting DoD business at all operating levels, including investigations, procurement, personnel, international matters and fiscal matters.

As the OIG's Designated Ethics Official, the incumbent executes the OIG Ethics Program, ensuring accurate reporting of financial interests by suspense dates established in law, rule or regulation; effective annual ethics training; and timely, responsive ethics advice and information to OIG employees.

The incumbent supervises the OIG's Freedom of Information Act (FOIA) and Privacy Act Office. He or she serves as the OIG FOIA Appellate Authority. He or she is responsible for implementation of all statutory and regulatory requirements relating to processing requests for OIG information.

Selected candidate will be subject to a two-year probationary period in the Senior Executive Service unless required probationary period has been served. Selectee may also be subject to a records review prior to being appointed to this position.

In accordance with Executive Order 12564, applicants selected are required to submit to a drug test and receive a negative drug test result prior to appointment. Incumbent is subject to random drug testing for the duration of service with the DoD OIG. Organizational entities with the DoD are not required to conduct drug testing for DoD civilian employees moving by transfer or reassignment from one DoD Testing Designated Position (TDP) to another TDP with no break in service within the DoD, unless deemed appropriate on a case-by-case basis by the gaining Component.

Selectee will be required to complete and submit an Executive Personnel Financial Disclosure Report, OGE-278, prior to entering the position and annually thereafter.

All newly appointed career SES leaders must sign the Reassignment Rights and Obligations Agreement as a condition of appointment into the SES in accordance with DoD Directive 1403.03.

Position has been designated as Special Sensitive; incumbent is required to be eligible (and maintain eligibility) for a Top Secret with Special Compartmented Information (TS/SCI).

Incumbent may be required to travel both in the Continental United States, as well as overseas locations.

Qualifications

Qualifications include both leadership skills and characteristics that are applicable to all SES positions, and technical or program responsibilities specific to the position. Eligibility for this position will be based upon a clear showing that the applicant has had experience of the scope and quality sufficient to effectively carry out the responsibilities of this position. The best qualified candidates will be distinguished from other applicants by an evaluation panel of subject matter experts referencing the Executive Core Qualifications (ECQs) and Technical Qualifications (TQs).

This position has been evaluated to be a Tier A position under the DoD OIG SES Personnel Management and Compensation System.

MANDATORY TECHNICAL QUALIFICATIONS:
The applicant is to provide a separate narrative statement to each of the following technical qualifications which describes fully, but concisely, how his/her experience supports each of the following qualifications. Each technical qualification narrative should not exceed 2 pages. Failure to address these specific qualifications in a separate narrative statement will eliminate you from consideration:

1. Management experience in leading and motivating a highly trained professional legal staff.

2. Diversified experience dealing with highly complex issues within a number of the subject areas relevant to the OIG, which include: appropriations and fiscal law; procurement/contract law; constitutional law; criminal law; and administrative law.

3. Comprehensive knowledge of DoD and/or government organization and operations and OIG responsibilities, policies, and business processes.

EXECUTIVE CORE QUALIFICATIONS (ECQs): The ECQs describe the leadership skills needed to succeed in the Senior Executive Service, and are in addition to the specific technical factors listed above. To assess the executive experience of each candidate, applicants who are applying for their initial career appointment in the SES must demonstrate, with specific examples, how their experience is relevant to exercising leadership in each of the five competencies. Current or former SES Career employees are not required to address the ECQs (SES Career employees include only those appointed under Title 5 U.S.C. 3393). A concise executive summary must show where and when the qualifications were obtained, the organizational setting in which the experience was acquired, (e.g. organizational size, level, and assigned fiscal resources), and a narrative discussion of the qualifications. The ECQs must not exceed 10 pages.
1. LEADING CHANGE. The ability to bring about strategic change, both within and outside the organization, to meet organizational goals. Inherent to this ECQ is the ability to establish an organizational vision and to implement it in a continuously changing environment.
2. LEADING PEOPLE. The ability to lead people toward meeting the organization's vision, mission and goals. Inherent to this ECQ is the ability to provide an inclusive workplace that fosters the development of others, facilitates cooperation and teamwork, and supports constructive resolution of conflicts.
3. RESULTS DRIVEN. The ability to meet organizational goals and customer expectations. Inherent to this ECQ is the ability to make decisions that produce high-quality results by applying technical knowledge, analyzing problems, and calculating risks.
4. BUSINESS ACUMEN. The ability to manage human, financial, and information resources strategically.
5. BUILDING COALITIONS. The ability to build coalitions internally and with other Federal agencies, State and local governments, nonprofit and private sector organizations, foreign governments, or international organizations to achieve common goals.

Education

Attorney positions have a positive education requirement. Applicant must possess a J.D. degree from a law school accredited by the American Bar and be an active member of the bar (any US jurisdiction).

Actual salary may vary depending on the scope and the complexity of the qualifications and current compensation of the selectee.

PCS/Relocation expenses, if authorized, will be in accordance with Joint Travel Regulations.

Veterans' preference does not apply to the SES.

Filling of this position is not subject to the provisions of the DOD Priority Placement Program (PPP).

Applicants will be evaluated based on the quality and extent of their experience, training, and/or education indicated on their resume and responses to the technical and executive qualifications listed above. Resumes will be evaluated by a rating and ranking panel, and best qualified candidates may be invited to participate in a structured interview. The Executive Resources Board (ERB) will review results and make recommendations on final selections to the approving authority.
