Summary

The Office of General Counsel within the National Indian Gaming Commission is seeking a candidate to serve as FOIA Officer overseeing the Commission’s Freedom of Information Act (FOIA) and Privacy Act (PA) program. The FOIA Officer will be responsible for directing the work of the FOIA office staff and developing program policy.

If selected for this position, you will be working for the National Indian Gaming Commission in the Office of General Counsel, Washington, DC.

The salary range for this position is equivalent to the following General Schedule grade levels and salary ranges:

GS-13 $94,796-$123,234 per annum.

GS-14 $112,021-$145,629 per annum.

This is a permanent, full-time, position in the Excepted Service. Competitive Civil Service status is not acquired under this appointment. New appointees to the Federal Government must serve a two year trial period. Merit promotion procedures do not apply.

The NIGC has determined that the duties of this position are suitable for telework with supervisor approval.

Help

Major Duties at the full performance level include, but are not limited to the following:


  1. Serves as the FOIA Officer, providing direction and leadership for the FOIA Office. Provides oversight and review to ensure that all draft FOIA and Privacy Act responses are complete, accurate, and timely, and that NIGC is in compliance with the statutes, NIGC regulations, U.S. DOJ guidance, related Executive orders, and agency FOIA and Privacy Act policies and procedures.
  2. Subject matter expert on current and new developments, legislative activities, and Federal government initiatives regarding FOIA and the Privacy Act.
  3. Performs in-depth review and analysis of incoming and backlogged requests. Prepares responses to voluminous, complex, and precedent-setting FOIA and Privacy Act requests.
  4. Plans, assigns, oversees, directs, reviews, and revises all FOIA staff’s work, correspondence, and draft responses, redactions, and withholdings for all FOIA and Privacy Act requests.
  5. Working with OGC, the incumbent ensures that all FOIA and Privacy Act responses are legally sound, including the use and applicability of various exemptions to FOIA such as deliberative process privilege, attorney client, attorney work product, confidential or privileged commercial or financial information, and any relevant Privacy Act exemptions.
  6. Monitors the electronic FOIA database to verify that all information and documents related to each FOIA and Privacy Act matter is timely input, accurate, and contained within the database.
  7. Performs the full range of supervisory functions for the FOIA office staff
Assignments will be specifically designed to prepare you for advancement to the next higher level without further competition. Advancement to the next higher level is not guaranteed, and depends on: (1) a demonstrated ability to successfully perform at the next higher level, to the satisfaction of the immediate supervisor; (2) the availability of sufficient work at the next higher level to warrant advancement; and (3) having satisfied all legal and regulatory requirements for advancement.

Qualifications

To qualify for this vacancy, you must meet the specialized experience requirements for the grade level you are applying.

Specialized Experience:

GS-13 equivalent

1. Utilizing FOIA policies/procedures, ensuring compliance with agency FOIA program requirements, and maintaining awareness of recent developments in the field;

2. assembling proposed FOIA release packages and conducting quality assurance on documents submitted by program offices;

3. assisting in the development and implementation of FOIA program procedures.

GS-14 equivalent

1. Analyzing complex FOIA responses to determine if they are in compliance with Agency and government-wide FOIA regulations and procedures;

2. preparing comprehensive responses to FOIA requests without oversight;

3. leading the development and implementation of FOIA program procedures.

Important Note : All National Indian Gaming Commission (NIGC) employees are subject to the conflict of interest restrictions imposed upon all employees of the Executive Branch of the Federal Government and may be required to file a Public Financial Disclosure Report (OGE-Form 278) or a Confidential Financial Disclosure Report (OGE Form 450) to determine if a conflict or an appearance of a conflict exists between your financial interest and your prospective position with the agency. This information will be required annually .

CONDITIONS OF EMPLOYMENT

A preliminary background check must be completed before a new employee can begin work with the National Indian Gaming Commission. The preliminary background check consists of a search of Office of Personnel Management and Department of Defense background investigation files and an FBI National Criminal History Fingerprint Check; it may take up to 3 weeks to complete. If selected for this position, you will be extended a tentative offer of employment pending a satisfactory background check. Current Federal employees or other individuals with an existing completed background investigation may not be required to undergo another background check; these will be handled on a case-by-case basis in coordination with the Bureau Security Office.
