Duties

Help

Serves as an official and spokesperson for the Office on a wide variety of complex and difficult domestic and international copyright law questions, including international copyright treaty and trade issues of the United States and related economic and trade issues with foreign countries.

Provides expert advice to the Associate Register and the Register of Copyrights on proposals for changes to aspects of the U.S. copyright law and international instruments affecting copyright. Proposes recommendations for revisions to Copyright Office operations and procedures as they may affect foreign authors and copyright owners and their works. Monitors and tracks closely all significant current developments in the field of copyright and intellectual property, including judicial activity (the progress of significant proposed or actual litigation), legislative activity, executive agency activities (developments at the Office of the U.S. Trade Representative, the U.S. Patent and Trademark Office, and others), and significant developments originating in external sources such as copyright and intellectual property bar associations, industry sectors, scholarly communities, user groups, and more.

Proactively explores a wide range of complex issues with policy implications for Copyright Office operations, programs and goals relative to its’ domestic and international policy activities. Examines and defines questions and issues, prepares alternative solutions and recommendations, including proposed policy statements and guidelines for the approval and/or decision of the Associate Register and, ultimately, the Register. As a member of the Register's senior team, collaborates with senior personnel in the Copyright Office including the Register in the identification of problems, the search for solutions, and the effective and efficient implementation of copyright-related statutes and agreements of the United States, particularly those with international implications.

Advises on the interpretation of copyright law in specific instances and participates in discussion and planning of policies affecting the United States Government's position in international meetings and diplomatic negotiations. Negotiates with representatives of foreign countries, travels in the United States and abroad to represent the Copyright Office or the United States Government. Serves on U.S. delegations to international copyright meetings of experts, working groups, committees, and sessions of governing bodies, cooperative councils, diplomatic conferences, and seminars. Establishes a cooperative working relationship with other U.S. agencies such as the U.S. Department of State, the Office of the U.S. Trade Representative, the Department of Commerce (including the U.S. Patent and Trademark Office) and others, as well as with international organizations such as the World Intellectual Property Organization and the United Nations Educational, Scientific, and Cultural Organization and other international, intergovernmental, and nongovernmental organizations.

Prepares correspondence, reports, position papers, and memoranda dealing with legal and international matters for the signature of the Register, the Associate Register, or own signature. Coordinates the drafting of both legal and non-legal speeches or statements. May approve all statements, publications, or special correspondence from the Copyright Office dealing with international copyright law. Contributes articles and other writings to law reviews, collections, professional journals, etc.

Performs the administrative and management functions relative to the staff supervised. Establishes guidelines and performance expectations for staff members which are clearly communicated through the formal employee performance management system. Observes workers' performance; demonstrates and conducts work performance critiques. Provides informal feedback and periodically evaluates employee performance. Resolves informal complaints and grievances. Develops work improvement plans, recommending personnel actions as necessary. Provides advice and counsel to workers related to work duties and administrative matters. Effects disciplinary measures as appropriate to the authority delegated in this area. Reviews and approves or disapproves leave requests. Assures that subordinates are trained and fully comply with the provisions of the safety regulations and building evacuation procedures. Provides professional supervisory oversight of the employees, some of whom perform at GS-15 grade level. Manages and supervises the administrative and technical aspect for accomplishing the work.

Conditions of Employment 

At present, the Library of Congress will not enforce an earlier policy to require all employees be vaccinated against COVID-19. However, employees are required to certify their vaccination status, which is used to plan and implement workplace safety protocols, such as those related to mask-wearing, physical distancing, testing, travel, and quarantine. Upon request, new hires may be required to show proof of vaccination to the Health Services Division. Library employees who are not vaccinated may be required to undergo testing for COVID-19 every seven days

Qualifications

The competencies below are required for this position.  Those marked with a double asterisk (**) are considered the most critical competencies for this position.  A candidate's resume must show a proven record of accomplishment that clearly demonstrates he or she has:

1.  Ability to manage and lead a diverse workforce.**  The successful candidate has demonstrated experience in an executive, supervisory or managerial capacity managing and leading a diverse workforce.

2.  Knowledge of domestic and international copyright and intellectual property matters.**  The successful candidate has demonstrated experience evidencing significant knowledge of copyright law and policy in domestic and/or international copyright fields. FOR EXAMPLE: On more than one occasion served as a guest speaker at copyright programs; published an article on domestic or international copyright law; was involved in copyright-related litigation or regulatory practice; possesses substantial background in copyright litigation, statutory licensing, copyright registration, and/or document recordation.

3.  Ability to convey legal analysis and information orally through briefings, consultations, and other presentations.**  The successful candidate has demonstrated experience in conveying analysis and information orally through briefings, consultations and other presentations.

4.  Ability to meet and deal with others.  The successful candidate has demonstrated the ability to develop and maintain relationships with a variety of individuals, including staff, management, and other stakeholders to accomplish the position’s duties.

5.  Ability to conduct and manage legal research and analysis of domestic and international copyright matters.  The successful candidate has demonstrated the ability to manage and perform legal research and analyze and evaluate information.

6.  Ability to communicate effectively other than in writing.  The successful candidate has demonstrated the ability to speak articulately, clearly, politely, and under control to others to both provide and seek information. This also includes targeting the amount, style and content of the information to the needs of the receiver, actively listening to and understanding information; and listening to and answering questions thoughtfully and completely.

Education

Applicants must possess an LL.B. or J.D., or higher degree from a full course of study in a school of law accredited by the American Bar Association or a state-accredited school of law and be an active member in good standing of the bar of a state, the District of Columbia, a territory of the United States, or the Commonwealth of Puerto Rico. Appointees must maintain active membership in good standing of the bar throughout their employment.

Legible copies of transcripts demonstrating that applicant is a graduate from an LL.B. or J.D., or higher degree program in a school of law accredited by the American Bar Association or a state-accredited school of law must be attached to your online application.  Unofficial transcripts are acceptable at the time of the application. Foreign Education – Education completed outside the U.S. must be deemed equivalent to conventional/accredited U.S. education programs to be acceptable for Federal employment.
