Duties

Major Duties and Responsibilities (MDRs)

  • Counsel will provide expert, authoritative advice and counsel to the ODNI General Counsel, ODNI senior leadership and staff on complex, difficult, and novel legal issues affecting the DNI's responsibilities as they relate to statutes, regulations, Executive Orders, Presidential Directives and policies. Counsel will also render definitive written opinions and associated oral guidance on a myriad of legal and policy issues. Furthermore, counsel will:
  • Provide authoritative support for the DNI's statutory responsibility to ensure compliance with the United States' Constitution and laws by the Intelligence Community's (IC) agencies and elements for which the DNI oversees.
  • Serve as the senior legal counsel to the Intelligence Advanced Research Projects Activity (IARPA).
  • Independently apply legal principles and use judgment to resolve complex legal matters facing the acquisition and procurement community, and research and analyze a wide variety of laws, regulations, and policies associated with acquisitions, procurements, facilities, technology and government ethics
  • Draft and/or review new legislation, Executive Orders, congressional testimony, and Intelligence Community Directives.
  • Establish and manage liaison relationships with external partners to ensure a comprehensive legal approach to acquisition and procurement law and policy, to include: (a) budget planning, programming and execution issues; (b) research and development programs; and (c) technology advancement.
  • Represent the OGC on a variety of intra- and inter-agency committees and working groups, and in hearings and briefings to Members of Congress and their staffs.
  • Maintain effective relationships with other Executive agencies and organizations, including the staffs of the National Security Council, the Office of Management and Budget, and the DoD General Counsel's Office.
  • Expertly negotiate complex contracts and other agreements with other agencies, private sector entities, and foreign liaisons.

Desired Requirements

  • In-depth knowledge of the mission and legal issues affecting the Intelligence Community and the ODNI with specialized experience in the following areas: (a) Major systems acquisitions, (b) National Intelligence Program budget and execution; (c) Basic and applied research, and the development of systems, including IT systems; and (d) Artificial Intelligence, machine learning and data management. Previous two performance reviews.

Qualifications

Mandatory and Educational Requirements

  • Demonstrated expertise in the following areas: (a) acquisition and procurement law and policy, to include major system acquisitions, source selections, and contract disputes; (b) intellectual property law, to include copyright, trademarks, and trade secrets.
  • Knowledge of the mission and legal issues affecting the IC with specialized experience in the following areas: (a) National Intelligence Program budget planning, programming and execution, and (b) Research and development contracting and program execution.
  • Superior written and oral communication, and research skills with demonstrated ability to think creatively to solve complex and novel legal issues and to gain consensus among disparate organizations on legal and national security issues.
  • Expert interviewing skills and techniques to skillfully collect relevant information from clients and stakeholders
  • Superior ability to balance client needs with professional objectivity and integrity.
  • Graduate of a law school accredited by the American Bar Association, and an active member in good standing of a Bar of one of the 50 states, the District of Columbia or a U.S. Territory or Commonwealth.
