OPLA is the largest legal program in the Department of Homeland Security (DHS), employing nearly 2,000 attorneys nationwide. In addition to Headquarters in Washington, D.C., there are 24 OPLA Field Locations in more than 60 cities throughout the United States. OPLA provides a full range of legal services to all ICE programs and offices. OPLA also serves as the exclusive representative of DHS in removal proceedings before the Executive Office for Immigration Review (EOIR), litigating cases involving criminal aliens, terrorists, human rights violators, and other priority aliens.

NSLD attorneys perform a variety of duties which are crucial in ICE's overall efforts to protect the national security of the United States, many of which involve working to combat international terrorism, counterterrorism, espionage, and other national security matters. For example, NSLD attorneys provide legal advice to OPLA Field Locations, Homeland Security Investigations (HSI), and Enforcement and Removal Operations (ERO) related to foreign students studying in the United States in F- or M-nonimmigrant status and administrative law in the context of certifying schools to enroll foreign students. Experience with the Administrative Procedure Act (APA) is beneficial.


Selectees will primarily:

  • Advise the HSI SEVP on administrative law issues which involve foreign students or the schools that enroll them, including on governing statutes and regulations in accord with the APA for certifying or withdrawing schools that are certified by SEVP to enroll nonimmigrant students;
  • Provide litigation support in administrative and federal litigation relating to SEVP adjudications or regulatory actions, and working with ICE leadership, Department of Justice, and DHS Office of the General Counsel Headquarters attorneys to coordinate the defense of cases;
  • Provide legal advice and counsel regarding regulations, executive orders, legislative proposals, and interpretation of the immigration laws that affect SEVP;
  • Advise SEVP personnel on the development and implementation of new policies;
  • Develop and provide legal training to SEVP adjudicators, HSI agents, and operational personnel on matters related to school and student regulatory compliance; and
  • Provide advice to ICE personnel on whether foreign students have violated their nonimmigrant status and are subject to removal from the United States.
In addition to the primary duties, selectees may be responsible for national security-related work on issues including, but not limited to: providing national oversight of, and litigation support to, OPLA Field Locations in their litigation of national security issues before the EOIR; working with other federal government agencies such as the Federal Bureau of Investigation and Department of Justice on national security matters; drafting briefing papers and Congressional testimony for DHS, ICE, and OPLA leadership; analyzing and drafting legislative proposals that affect national security; and providing well-reasoned legal advice regarding immigration issues relating to national security.

Given the nature of NSLD's work, the attorney(s) selected in response to this announcement will be given significant responsibilities on an immediate basis.

Applicants should be able to efficiently produce quality legal analyses of complex and novel issues, exercise sound legal judgment, prioritize competing assignments, and work effectively independently, as part of a team, and across work units. Applicants should be detail-oriented and have a strong interest in supporting and providing stellar client services to program offices, including law enforcement officers, policymakers, attorneys, and agency senior leadership, and must be able to tailor communications to a particular audience. Applicants should be able to take the initiative and work in a reliable, decisive, and professional manner.

Applicants should possess the following characteristics and competencies: integrity, sound professional judgment, organizational skills, decisiveness, initiative, stellar client services, the ability to function independently and cooperatively, and superior written and oral advocacy skills.

Bar Membership: You must be an active member in good standing of the bar of a state, territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico.

Education

Applicants must be graduates of an accredited law school with a Juris Doctor (J.D.) or LLM degree.

Promotion Potential: This position has promotion potential to the GS-15. When promotion potential is shown, the agency is not making a commitment and is not obligated to provide future promotions to you if you are selected.
