As Chief, Foreign Investment Review Section, (FIRS) of the National Security Division (NSD) of the Department of Justice (DOJ). The Chief exercises full responsibility for carrying out all policy, programmatic, and managerial matters assigned or required to assure effective and efficient operations of FIRS. FIRS serves as the Department's operational arm for reviewing certain transactions involving acquisitions of U.S. companies by foreign companies for national security concerns (through the Committee on Foreign Investment in the United States (CFIUS) and exercises the Attorney General's day-to-day responsibilities as Chair of Team Telecom (formally known as the Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector), which advises the Federal Communication Commission (FCC) regarding the granting of particular licenses to foreign-owned or -controlled entities. FIRS also manages NSD's participation in the Administration's supply chain security, emerging and high technology, and national security risk impact work, to include compliance and enforcement related to these topics.
The Chief is the principal legal advisor responsible for providing expert advice and guidance to the NSD's senior leadership on reviews of foreign acquisitions of domestic entities that might affect national security; tracking and monitoring of transactions that have been approved and identifying unreported transactions that might merit review; responding to FCC requests for the Department's views relating to the national security implications of certain transactions relating to FCC licenses; and identifying policy and legal gaps that must be addressed to further national security.
Primary responsibilities include but are not limited to the following:
-Directs and supervises the attorneys' review of transactions within FIRS's jurisdiction, participation in interagency negotiations related to those transactions, and legal research and policy support related to matters falling within FIRS's responsibility, including the nexus of emerging technology and national security.
-Leads the work of the Division in providing policy leadership and legal counsel on a variety of topics at the intersection of sophisticated communications technology, informatics, information systems, data aggregation and utilization, international equipment and services trade, and security.
-Maintains close and personal liaison relationships with the FBI and other agencies working on foreign investment-related issues. The Chief responds to inquiries from Congress and other agencies on national security matters within FIRS's purview.
-Consults with and advises the Attorney General, the Deputy Attorney General, the Assistant Attorney General and the Deputy Assistant Attorney General of NSD and other government officials and departments on questions of law and policy relating to national security issues within FIRS's purview.
-Acquires and leverages needed fiscal and human resources to achieve results-oriented outcomes and develops budget enhancements that include both performance measures and outcomes that reflect FIRS's, the Division's, and the Department's strategic goals and objectives.
-Ensures that resource enhancements necessary for proposed priorities are identified and justified and uses efficient and cost-effective approaches to integrate technology into the workplace for improved program effectiveness.
