The Senior Level Special Trial Attorney (SL STA) serves as a national expert on tax litigation and as a confidential advisor to the Division Counsel (Large Business & International) (LB&I) and, as assigned, the lead trial attorney on some of the Office of Chief Counsel’s most significant cases. Because of the outstanding stature of the SL STA in the tax law and litigation fields, the incumbent’s opinions in legal, technical, tactical, strategic, and tax matters related to litigation are highly sought after and recognized as particularly authoritative and highly influential. The SL STA also serves as the Division’s and the Office’s representative and liaison on the most significant assigned litigation or litigation-related matters with the IRS, the Department of Justice, and the Department of the Treasury.

Acts as a national expert, providing legal and technical expertise to the Division Counsel, other Division executives, managers, STAs, and attorneys on the most difficult, significant, and complex matters arising in tax litigation and in the administration of the Internal Revenue laws.
Oversees, manages, and leads all aspects of the most significant cases in litigation before the United States Tax Court. Oversees large case trial teams, delegating responsibilities as appropriate to trial team members. Formulates litigation tactics and strategy; hires, prepares, and presents expert witnesses; conducts and defends discovery, including electronic discovery (eDiscovery); prepares and argues pre-trial motions; leads trial teams in the courtroom; and oversees the post-trial briefing process and the submission of the briefs and all related motions and filings.
Advises the Division Counsel, other Division executives, Counsel executives, and managers on case-specific and program issues under examination, including effectively identifying and positioning tax and tax-related issues for future settlement and litigation, properly using experts, drafting Information Document Requests, conducting witness interviews and summonses, fact gathering, and developing legal theories and strategies.
Works with the exam team while cases are under examination and/or trial team while cases are in litigation to ensure all data (hard copy or electronically stored information) is properly preserved, collected, reviewed and analyzed. Develops strategy for preserving relevant data and drafting, implementing, and preparing litigation holds and preservation orders. Creates data analysis plans for review of documents and assertion of all proper privileges in a timely manner. Possesses comprehensive understanding of information governance issues. Provides leadership to advance Counsel’s and the IRS’ interests in connection with requirements imposed by applicable court rules and other controlling legal authorities.
Performs other duties as assigned and delegated by the Chief Counsel, the Deputy Chief Counsel, or the Division Counsel.
