About the Position: This position is in the Defense Civilian Intelligence Personnel System (DCIPS). Employees occupying DCIPS positions are in the Excepted Service and must adhere to U.S. Code, Title 10, as well as Department of Defense Instruction 1400.25. This position is located at the US Army Intelligence & Security Command, 470th Military Intelligence, HHD AUG MI, located at Fort Sam Houston, Texas.

Provides legal advice to the 470th MI BDE Commander, Staff, and subordinate units on administrative investigations such as but not limited to, security violation, mishandling of classified information, financial liability investigations of property loss, or allegations of minor misconduct that violates the Uniform Code of Military Justice. Advises investigating officers concerning questions that arise during their investigations and on appropriate administrative actions to take based on the results of those investigations. Provides advice and written legal opinions on all matters requiring Ethics opinions and decisions, and ensures compliance with all applicable ethics regulations and policies when conducting official activities. Serves as the principal ethics counselor within the BDE. Issues advisory opinions on matters involving conflicts of interest, misuse of government position, disqualification, outside employment, post-Government employment, gifts from outside sources, prohibited sources, gifts between employees, use of official travel resources, impartiality in performing official duties, and impermissible government endorsement issues. Serves as BDE coordinator for annual financial disclosure reporting required by the Office of Government Ethics and reviews submitted reports. Advises in all matters and inquiries from all regulating and oversight bodies to include INSCOM, Army Staff, Congressional, and Executive Intelligence Oversight Committees. Prepares legal opinions on Freedom of Information Act (FOIA) and Privacy Act on all matters involving the release or potential release of intelligence and CI sensitive information, operations, or activities. This includes, but is not limited to, review and recommended redactions, and markings of such documents to ensure compliance with the FOIA statute. Provides fiscal and contract law advice and writes opinions on the expenditure of various fund types to support on-going intelligence operations and activities. Assists the 470th BJA on matters pertaining to Federal employees including Management Employee Relations (MER) and preparation and presentation of matters associated with representing the command on issues arising out of claims within the purview of the Equal Employment Opportunity Commission (EEOC) and Merit Systems Protection Board (MSPB). Develops and presents training classes on various legal topics to military and civilian employees required by policy and regulation.

Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position.
1. Ability to analyze and problem-solve a wide variety of legal issues related to intelligence and national security law. Knowledge of the statutes, regulations and case law related to intelligence and national security law.
2. Knowledge of federal administrative law to include statutes, regulations, and case law related to the FOIA, Privacy Act (PA), administrative investigations, fiscal law, federal acquisition law, ethics, standards of conduct, executive orders and regulations.
3. Knowledge of federal and/or DoD civilian personnel laws and the ability to litigate sensitive cases before the equal employment opportunity commission and Merit System Protection Board.
4. Ability to write clear and concise legal documents.

The following minimum qualification requirements must be met before applicants are eligible for further consideration.
1) Education: An applicant must have successfully completed a full course study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).
2) Bar Membership: An applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
3) Experience: Applicant must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
