The Deputy General Counsel for Legal Counsel advises the Commission and staff on issues of law and policy, including the Commission's Rules of Practice and federal court litigation, and helps assure agency compliance with such statutes and regulations as the Administrative Procedure Act, the Government in the Sunshine Act, the Freedom of Information Act (FOIA), the Federal Procurement Act, the Paperwork Reduction Act, and the Civil Service Reform Act.. The position encompasses responsibilities that include providing technical assistance on proposed legislative and regulatory efforts, OGC and agency policies, and the agency's long-range strategic goals and objectives.
The Deputy General Counsel for Legal Counsel reports to and works under the broad administrative direction of the General Counsel and Principal Deputy General Counsel, who provide direction in the form of broad program policy, resources available, and overall goals to achieve. The incumbent is a key member of the General Counsel's senior management team and is delegated to act for the General Counsel in interpreting and carrying out goals and objectives in assigned areas of OGC matters. In fulfilling these responsibilities, the Deputy General Counsel for Legal Counsel is responsible, with the other senior management team members, for strategic planning regarding OGC's role in agency missions, and serves as a primary link between OGC, Bureau and Office heads, and FTC Commissioners.
The incumbent also prepares responses to formal Congressional requests for information about Commission actions, conducts or assists with briefings of Congressional staff members, and prepares or assists in the preparation of testimony for Congressional hearings. The Deputy General Counsel for Legal Counsel also prepares opinions, reports, recommendations, and provides other services for the agency on a wide variety of subjects related to administrative law, policy, and procedure relative to the acts and statutes administered by the agency, which arise in connection with proposed or existing programs or work.
The incumbent's accountability for the success of OGC programs and projects encompasses the full range of factors that affect program and project accomplishment. This includes obtaining the resources necessary to accomplish the programs or projects, as well as dealing with key officials within and outside the agency to gain understanding of and support for the agency's and General Counsel's work. The incumbent ensures that the Legal Counsel team uses its resources effectively, in accordance with resource and budget constraints. The incumbent structures the work of the Legal Counsel team to promote effective work accomplishment; sets effectiveness, efficiency, and productivity performance requirements; and implements management and internal control standards. The incumbent monitors and evaluates the Legal Counsel team's progress toward accomplishing goals through formal and informal means, periodically evaluates and makes appropriate adjustments to such goals, and assesses the Legal Counsel team's overall effectiveness, efficiency, and productivity.
The incumbent professionally and administratively directs, oversees, supervises, coordinates, and reviews (including through subordinate supervisors) the work of attorneys engaged in providing legal advice to the agency and its staff. Leads, trains, and directs a group of mid-level and senior attorneys, in addition to legal support staff, in accomplishing OGC's goals and objectives. Ensures the training, development, and effective use of Legal Counsel staff, evaluates work product, conducts formal performance reviews, takes action to correct performance of conduct deficiencies, and recommends promotions, awards, and other personnel actions. Assesses policy, program, and project feasibility, determines project goals and objectives, and develops plans to achieve goals and objectives. Identifies, diagnoses, and consults on problem areas related to assignments and goal achievement and makes decisions on alternative courses of action.
The incumbent directs, oversees, supervises, coordinates, and reviews (through subordinate supervisors) the work of the FOIA team and serves as the Agency Chief FOIA Officer. The incumbent has agency-wide responsibility for efficient and appropriate compliance with FOIA, monitors the implementation of FOIA throughout the agency, and keeps the head of the agency and the General Counsel appropriately informed of the agency's performance in implementing FOIA. Recommends to the head of the agency such adjustments to agency practices, policies, personnel, and funding as may be necessary to improve its implementation of FOIA.
