A ATTORNEY-ADVISER (GENERAL), GS-0905-13,
1. Acts as a legal advisor and attorney for the state/territory National Guard, responsible for the formulation of state/territory legal policy and its execution legal representation; legal initiatives; interpretation and litigation of U.S. and state/territory(s) constitutional, civil, criminal, labor law; international law and treaty agreements; and a full spectrum of expert legal advice. Acts as a legal advisor and attorney for the state/territory National Guard, responsible for assisting in the formulation of state/territory legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General, the Office of Staff Judge Advocate (OSJA), the J9 Directorate, the Command's SARC and SEEM programs. Coordinator and advisor in the OSJA pertaining to military justice/adverse actions that are initiated against alleged offenders. Serves as the primary point of contact for outside entities and stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM Manager preventing future harm to victims by ensuring the proper procedures are implemented and followed and that justice and adverse actions are administered properly. Assignments include some of the most diverse, complex, difficult, and novel legal issues found in the emerging area of victims' right law and is responsible for the formulation of state/territory legal policy and its execution in the area of sexual assault accountability, prevention, and response; sexual harassment; domestic abuse and lines of duty and medical discharges for Army and Air personnel. Included in this duty is to assist the Adjutant General, after any required coordination with the National Guard (NG) Special Victims' Counsel Program in publishing the accountability actions taken associated with substantiated allegations of sexual assault, domestic sexual abuse, and sexual harassment (both formal complaints and violations of the UCMJ), and to coordinate with local law enforcement, prosecutors, and MCIOs to track cases of sexual assault involving NG perpetrators or victims, and to provide legal support to staff elements whose duties include sexual assault accountability, prevention, and response, including retaliation and reprisal.
2. Responsible to advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive, and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Serves as legal counsel to Adjutant General and Commanders on legislation, regulation, or guidance as to creating protective environments and promoting healthy social norms specific to military communities, which can include advising on any collaborations with local, state, and federal partners such as county health departments, State health departments, schools, the CDC, other government agencies, and/or other industry that can ensure that the military can evaluate and assess the impact of their community-level prevention strategies both in the short and long-term. Responsible for advising on any policy or guidance regarding the removal of restrictive policies on sensitive data collection in order to advance primary prevention of sexual harassment and sexual assault in the military.
3. Serves as the state National Guard litigation point of contact. Represents the state National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to sexual crimes, sexual harassment, and domestic violence/abuse. Acts as agency counsel for the state National Guard with the National Guard Bureau Office of Litigation and Employment Law Division, Department of Army and Department of Air Force Litigation Divisions, and the Department of Justice, for Federal courts of original or appellate jurisdictions.
4. Serves as an attorney/adviser providing acquisition and fiscal legal advice to the state/territory's assigned United States Property & Fiscal Officer, particularly in the area of emerging requirements in victim support and legal resourcing (the Chief of the National Guard Bureau's agent in the state/territory) and active-duty military advisors. Preforms other duties as assigned.
CONDITIONS OF EMPLOYMENT
EDUCATION:
Army National Guard Officers: For entry into the Army National Guard JAG Corps/ Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an an ABA- accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.
Air National Guard Officers: For entry into the Air National Guard JAG Corps/Attorney-Adviser, it is mandatory to have a Bachelor of Laws or Juris Doctor degree in law issued by an ABA-accredited law school; and, must be admitted to practice law in the highest court of any U.S. state, commonwealth, territory or the District of Columbia.
ADDITIONALLY:
As an Officer in the Army National Guard JAG Corps, must have completed the 14-week Judge Advocate General Basic Course.
As an Officer in the Air National Guard, must have completed the nine-week Judge Advocate Staff Course.

REMARKS: No PCS available. Position will not be filled until current incumbent vacates. Sensitivity Level 2. Participation in direct deposit is mandatory. - Males born after 31 December 1959 must be registered for Selective Service. Work may require frequent travel away from the normal duty station on military and commercial aircraft. The work may require the employee to drive a motor vehicle. An appropriate, valid driver's license may be required for the position.
