The person selected will be a supervisory attorney advisor in the Department of Labor, Office of the Solicitor (SOL), Division of Management and Administrative Legal Services (MALS). SOL’s mission is to meet the legal service demands of the entire Department of Labor and help ensure that the Nation’s labor laws are forcefully and fairly applied to protect the Nation’s workers. The MALS Division provides the Department of Labor with legal advice and litigation services relating to a variety of governmental and management legal issues, such as appropriations, procurement, labor relations and information law issues, and also serves as the administrative arm of the Office of the Solicitor.
As Appropriations Law Counsel, the incumbent is responsible for the assignment, direction and review of the work of attorneys providing legal services to the Department under statutes and their implementing regulations relating to appropriations, budget and financial management, and organizational authority and delegations. The Counsel supervises a team of specialized attorneys and coordinates with other legal offices. Key legal authorities include, but are not limited to the Anti-deficiency Act, the Bona Fide Needs Statute, the Miscellaneous Receipts Statute, the Purpose Statute, the Department’s organic authority statutes, the Housekeeping Statutes, and other authorities that materially relate to the Secretary’s Constitutional authority and duties. Legal services include the formulation and coordination of the Department’s response to complex, sensitive, and novel authorization, appropriations, and budget issues, as well as the preparation of legal opinions necessary to advise on and resolve such issues. The incumbent develops and analyzes, for Departmental program and financial management officials, legal and policy options and strategies for budget formulation and execution in conformity with the applicable statutes and regulations.
The Counsel drafts and reviews for legal sufficiency and broad policy implications the Department’s legislative proposals, proposed Secretarial Orders, and other directives and documents, including interagency agreements, grants, cooperative agreements, and memoranda of understanding, prepared by DOL and other government agencies. The incumbent is the primary source of legal advice in the assigned areas of responsibility. The incumbent researches and writes a variety of policy and issue papers and complex correspondence at the request of DOL officials such as the Solicitor, the Deputy Secretary, and Secretary, and as it relates to DOL appropriations, may prepare and review internal and external reports, communications, testimonies and rulemaking comments relating to DOL programs and operations for a variety of audiences such as the Congress, the Office of Management and Budget and the Government Accountability Office. Key clients are the Office of the Assistant Secretary for Administration and Management, the Chief Financial Officer, and various other DOL agencies in the area of federal appropriations and fiscal law. The Counsel, in conjunction with or in the absence of the Procurement Law Counsel, may also supervise and direct subordinate attorneys in the provision of legal advice and litigation service related to acquisition and financial assistance, contracts, procurement, and intellectual property. Key clients are the Office of the Assistant Secretary for Administration and Management, the Chief Financial Officer, the Chief Acquisition Officer, and various other DOL agencies in the area of federal procurement and grant law.

To qualify for an attorney position, applicants must possess a professional law degree (LL.B. or J.D.); be a member in good standing of the bar of a court of general jurisdiction of a state, territory or possession of the U.S.; and have acquired the amount of experience indicated below for each grade level.
GS-15, four (4) years of progressively responsible legal experience of a professional nature which demonstrates the ability to perform the work at this level. At least one year of qualifying experience, at this level, must be specialized experience as defined below.
Specialized experience, for this grade level, is experience as a practicing attorney at, or equivalent to the GS-14 grade level, that has equipped the applicant with the necessary skills and abilities to perform the major duties of this position.
Note: In addition, an LL.M may be substituted for a maximum of one year of the four years of progressively responsible legal experience.
