    Summary

    Employee Benefits Security Administration (EBSA) is responsible for administering the Employee Retirement Income Security Act of 1974 (ERISA) by planning, directing, and administering a program of enforcement to ensure maximum compliance and the criminal provisions of the United States Code as they relate to employee benefit plans.

    Responsibilities

    Under close supervision, the incumbent plans and conducts audits and financial examinations of employee pension and welfare plans and service providers having relationships with employee benefit plans to determine civil and criminal compliance with ERISA and related laws and regulations.  Investigations at this level typically involve audits or reviews of small single or third party entities and/or a multitude of civil and/or criminal violations.  Will develop background information from plan reports, financial data, official documents, systems reports, etc.  Examines records to determine if transactions conducted, plan policies and operations, and financial interrelationships meet the specific regulatory requirements and standards for prudent management of funds.  Meets with accountants, auditors, attorneys, plan administrators, employers, etc. to obtain factual information.  Prepares reports of investigative findings.  Prepare summaries of meetings and conferences for higher-level review and use.  Works with the legal staff of the Department’s Office of the Solicitor and Department of Justice in preparing cases for civil litigation or criminal prosecution by developing documentary evidence.
