    Summary

    Incumbent will serve as an expert class action litigator with significant experience litigating complex class action cases in federal court and before administrative tribunals.

    Responsibilities

    Handles all aspects of class litigation including class certification, class decertification/modification, discovery, motion practice, trial and appeal.

    Responsible for drafting pleadings, motions, appeals and any other written documents related to the defense of class actions and complex employment litigation.

    In coordination with the Chief Counsel, Deputy Chief Counsel and Assistant Chief Counsel for Employment and Labor Law, routinely interacts with high-level agency management officials including high-level regional, center, service area and headquarters managers to provide expert legal advice and strategy about class actions including settlement options.

    Represents the Agency in employment and labor law matters before the Equal Employment Opportunity Commission (EEOC), Merit Systems Protection Board (MSPB), and other administrative fora; and, in conjunction with the Department of Justice and US Attorney’s Offices, in federal courts.

    Assesses the need for outside counsel to support FAA class action litigation.

    In coordination with the Director, Administrative Services prepares for consideration by the Chief Counsel and Assistant Chief Counsel for Employment and Labor Law, business cases to support the acquisition of outside counsel, to include proposed legal strategy and projected costs.

    Deals with extremely complex and difficult legal questions or factual issues that may require original and creative legal thinking to resolve.

    Works independently and has broad discretion to ensure alignment with organizational objectives and policies.

    Establishes and maintains a high level of trust with executive-level management of the Office of the Chief Counsel, agency executives, senior managers or officials of the FAA, the DOT, OMB and other federal agencies.

    Occasional travel - The job may require travel from time- to-time, but not on a regular basis. The travel may be for training or other work-related duties.
