This position is located in the Federal Trade Commission, Bureau of Competition, Mergers IV Division. The division investigates transactions involving hospitals, consumer goods, supermarkets, casinos distribution industries, funeral homes, and retail outlets, among others. The Division has litigated a number of cases in federal court and through the Commission’s administrative process, including Sanford Health/Mid Dakota Clinic; Staples/Office Depot; Advocate Health Care/NorthShore University HealthSystem; Sysco/US Foods; ProMedica Health System/St. Luke’s Hospital; Phoebe Putney Health System/Palmyra Memorial Hospital; and OSF Healthcare/Rockford Health System.Learn more about this agency
As an attorney in the Mergers IV Division you will perform a variety of legal and investigative duties relating to merger investigations and litigation. Common tasks include contacting third parties, managing subpoena responses, and liaising with state attorneys general. A successful staff member has interest in and the ability to deal with both legal analysis and economic and practical business issues arising from the matters under investigation. More specifically you will:
Make recommendations as to whether a merger warrants a full phase investigation;
Plan and conduct investigations of potentially anticompetitive mergers in a variety of industries, usually working as a member of a team;
Based on evidence collected during an investigation, and on applicable legal precedents, recommend whether a merger should be challenged;
Prepare for trial and litigate those matters; and
Perform special assignments as directed.
