This position is located in the Litigation Division, Office of General Counsel, Federal Communications Commission located in Washington, DC. The Litigation Division is responsible for advising and representing the Commission: (a) in all appellate proceedings, including action before the Supreme Court of the United States, in which the Commission is a party or otherwise possesses a public interest in the question involved, and takes action in civil and criminal cases to defend and enforce the Communications Act, Commission rules and regulations, Commission orders, and other actions by the Commission or its staff (including personnel actions); (b) in all actions and proceedings commenced in the U.S. District Courts in which the Commission is a party or otherwise possesses an interest in the question involved as well as in proceedings before various tribunals, including the Office of Special Counsel, Merit Systems Protection Board, and the Equal Employment Opportunity Commission. Further, the Litigation Division advises the Commission as to any legal questions involved in proposed actions and policies in the light of past and pending appellate or trial litigation.
The incumbent serves as a senior trial attorney with primary responsibility for representing the Commission in litigation matters and administrative proceedings involving human resources law, labor relations and other legal projects and initiatives, which may raise complex, legal, factual and other issues. He/she provides legal guidance and support to managers and supervisors in the Office of General Counsel. The incumbent reports directly to the Associate General Counsel of the Litigation Division.
In addition to representing the Commission in litigation matters and administrative proceedings involving human resources law and labor relations, incumbent may be responsible for handling and coordinating other litigation in the United States District Courts, including enforcement proceedings and Freedom of Information Act litigation; drafting appellate briefs and presenting oral arguments in the federal appellate courts; responding to subpoenas served upon the agency; and otherwise assisting OGC's managers and supervisors.
