The Office of Appellate Operations consists of the Appeals Council (an administrative body that has adjudicative authority) and its support staff. The Appeals Council is the final level of administrative review for claims filed under titles II, VIII, and XVI of the Social Security Act, (Act) as amended. Incumbents may be assigned to any subordinate branch within the Divisions of Program Adjudication (I - VII), Division of Civil Actions, or the Division of Quality. Incumbents perform complex legally-based, technical and professional work that supports the Appeals Council's programmatic and adjudication responsibilities, which include preparing and reviewing cases in which: (1) the claimant has filed a request for review of the administrative law judge's (ALJ) decision; (2) another SSA component files a "bureau protest"; (3) the Appeals Council assumes jurisdiction of the case on its own motion; or (4) a civil action has been filed in a United States Court. In addition, incumbents conduct quality review audits of cases filed at the hearings, appeals, and civil actions adjudication levels to ensure that ALJ and Appeals Council decisions comply with applicable laws, regulations, policies, and procedures. Incumbents provide research, analyses, and recommendations to support the Appeals Council in achieving the agency's goals and objectives. The incumbent must be admitted to the Bar of a State, Territory of the United States, or the District of Columbia and meet all requirements established by the Office of Personnel Management in this regard.
Provides assistance to the Appeals Council to ensure proper application and interpretation of the provisions of titles II, VIII, and XVI of the Act and disposition of cases coming before the Appeals Council. Performs an in-depth review of the facts of the case; researches legal aspects of the case as necessary; analyzes the legal sufficiency of the ALJ's decision or dismissal; identifies complex and difficult issues in the interpretation of, or application of court rulings, legislation, regulations and agency decisions and opinions to arrive at technically sufficient and legally sound conclusions, and presents such conclusions in writing to the Appeals Council, ensuring that the analysis or recommendation includes appropriate reference to statutes, regulations, and Social Security Rulings.
Reviews and drafts proposed Appeals Council actions and recommendations for disposition of the most complex cases, such as those involving significant policy, legal or precedent-setting issues.
Applicants will be rated using a 100-point scale and evaluated according to the following criteria:
Position to be filled under the provisions of the SSA/AFGE Merit Promotion Plan. Additional selections may be made within 3 months of the date of the initial selection.
LOCALITY PAY: Salary will be set in accordance with locality pay provisions. Candidates currently receiving a higher locality pay than the office applied for are advised that should they be selected, they will lose entitlement to the higher locality pay.
