The Office of the General Counsel is looking for an energetic, innovative legal officer who will enjoy working in a dynamic and mission driven organization as the Chief, Employment and Labor Law Division, Office of the General Counsel.
The Office of the General Counsel, Employment and Labor Law Division, undertakes the additional, executive-level responsibility of assisting in the planning and restructuring or revolutionizing of the Department of Commerce’s (Department) organizational design in response to Administration or Secretarial initiatives, as well as in response to Congressional budgetary cuts. As the Chief of the Employment and Labor Law Division, the incumbent will be the principal advisor to the Assistant General Counsel, the General Counsel, and senior Departmental officials on matters relating to federal laws of major significance, which substantially impact the personnel administration and labor-management activities of the Department. The incumbent will have Department-wide responsibility for the conduct and supervision of all employment and labor-management relations litigation and provision of strategic information on these matters to the Department’s managers and planners at the highest level.

The Chief, Employment and Labor Law Division, will be responsible for the following:
1. Exercise executive leadership and vision in the design and identification of alternative organizational structures for the various Department bureaus. Analyzes functionality, identifies legal considerations with regard to personnel and labor relations requirements, and explores conceptual implementation of such organizational units with OMB and OPM. Identifies broad strategies for integrating presidential management initiatives into existing and planned restructuring of the Department. Exercises leadership at intergovernmental meetings, involving cabinet-level departments and agencies. Is expected to negotiate, adapt, analyze, and integrate, based on a legal perspective, suggestions regarding the Department’s management initiatives and programs.
2. Provide leadership at the Departmental level to senior bureau officials and Secretarial Officers regarding presidential management initiatives, restructuring, or streamlining changes. Advises and negotiates with officials at the highest levels within the Department regarding modifications to the existing organizational personnel legal issues that have cross-cutting applicability for the Department.
3. Serve as the chief legal representative of the Department and supervises other attorneys with regard to employment and labor-management relations litigation including: disciplinary and adverse actions; reduction-in-force and furlough actions; arbitrations under collective bargaining agreements; negotiation impasses, unfair labor practice complaints; and discrimination complaints. This involves the supervision of subordinate attorneys’ case preparations and presentations in U.S. district and appellate courts, as well as quasi-judicial administrative hearings before the Federal Labor Relations Authority, Federal Service Impasses Panel, Merit Systems Protection Board, Office of Special Counsel, and Equal Employment Opportunity Commission. Incumbent exercises substantial autonomy with regard to the conduct of legal matters involving Department personnel administration and labor-management relations.
4. Conduct extensive legal research and prepares legal memoranda concerning complex and difficult questions involving the interpretation and application of laws related to administration of the Department, where there are employment and/or labor-management relations implications, including accurate analyses of risks associated with alternative courses of action available to the Department’s senior policy and program officials.
5. Serve as the Office of the General Counsel’s representative on internal councils and boards upon request, include membership on the Principal Human Resources Managers Council, the Diversity and Inclusion Council, and the Department Labor-Management Forum.
6. Represent the Office when coordination and communication is necessary and useful with other department or agency legal offices, including other offices of the General Counsel and Bureau legal offices. Represents or supervises the representation of the Department in litigation which also affects other agencies, including the Office of Personnel Management. Seeks out and leads inter-agency groups representing departments or agencies wishing collectively to work together on employment or labor law issues for mutual benefit. Participates in interoffice groups and task forces. In order to carry out this function, incumbent must develop/apply an in-depth knowledge and understanding of the Department's operations, the mission and policies of the various operating units, and the sensitivities and current policies of the Department's leaders.
