Serves as an Attorney Adviser to one or more Administrative Law Judges (ALJs) rendering advice and assistance in pre-hearing development and preparation of cases for hearing, post-hearing development and other post-hearing actions. Typically, the incumbent: drafts decisions for ALJs in some of the more sensitive and/or legally complex cases involving significant policy issues and questions regarding the application of Federal Circuit Court opinions or Acquiescence Rulings in particular cases; performs research and identifies unusual issues typically related to matters of State law; thoroughly reviews class action cases and cases remanded by the Courts and the Appeals Council; drafts interrogatories to medical and vocational experts; reviews and evaluates highly complex disability cases which require reevaluation to comply with Agency interpretation of U.S. Supreme Court Decisions; responsible for formulating legally defensible decisions which address all medical and legal aspects of even the most difficult cases; and provides information to the claimant and/or his/her representative concerning applicable laws, procedures and requirements.
MUST SUBMIT PROOF OF BAR MEMEBERSHIP . MUST SHOW CURRENT YEAR (2017).
Applicants must have a law degree in order to qualify for this position. A copy of your transcripts or other proof of education documenting the successful completion of a law degree must be uploaded before the vacancy closes.
GS-11 MUST have the First Professional Law Degree (J.D.) PLUS submit PROOF of current membership in the Bar PLUS one of the following:
1. One year of substantial professional legal experience;(or)
2. A second Professional Law Degree (LL.M.), which requires one full year of graduate study.
3. The First Professional Law Degree provided the applicant's records to reflect superior law student work or activities as demonstrated by one of the following:
A. Academic standing in the upper third of the law school graduating class as reflected in a copy of their transcripts (Must submit transcript).
B. OR work or achievement of significance on the law school's official law review.
C. OR special high level honor for academic excellence in law school, such as election to the Order of the Coif, OR winning of a moot court competition, OR membership on the moot court team which represents the law school in competition with other law schools.
D. OR full-time or continuous participation in a legal aid program as opposed to a one-time, intermittent, or casual participation.
E. OR significant law office clerk experience.
F. OR other equivalent evidence of superior achievements.
GS-12 ALL requirements for the GS-11 PLUS: One additional year (i.e. 52 weeks of full time) of professional legal experience equivalent to the GS-11 level involving ALL of the following: - complex and difficult legal questions requiring extensive research, analysis and evaluation, and - extensive legal/medical writing, and - detailed knowledge of Social Security Programs OR experience as a hearing examiner, magistrate, judge protem, administrative law judge, bankruptcy trustee, military judge or member of a Board of Military Review, or similar decision making positions.
