Duties

The Associate Solicitor for Black Lung and Longshore Legal Services with subordinate staff of approximately 30 professional, technical and clerical employees is responsible for planning, organizing, directing and conducting all litigation activities carried out under the statutes with the Division's jurisdiction before administrative law judges, the Benefits Review Board, the various United States Districts Courts and the Federal Courts of Appeals. At the national level, litigation includes appellate cases, cases involving issues of special legal or policy significance or interest, cases that cross regional lines, those cases for which a decision has made for direct handling by the incumbent due to policy or other considerations, and such other litigation as is not delegated to the Regional Offices.

The incumbent is responsible for coordinating the development of national policy with senior client officials by identifying, and directing the litigation of, appropriate cases. The incumbent also protects the financial interests of the Black Lung Disability Trust Fund by enforcing final benefit awards and pressing other claims for reimbursement in bankruptcy and Federal Districts Courts.

Under the incumbent’ s direction, staff attorneys prepare interpretation and opinions dealing with a variety of complex legal questions for Departmental officials and provide legal services to OWCP with respect to the development and drafting of regulations and guidelines implementing the statutes and policies within the Division’s area of responsibility. Incumbent is responsible for providing coordination and guidance to the several agency Regional Offices to the extent that these organizational elements are involved in the work of the Division. The incumbent represents the Solicitor and the Secretary on Departmental and interdepartmental task forces and at conferences and meetings concerning matters within the Division’s area of responsibility.
