About the Agency

The Federal Trade Commission, Office of the General Counsel seeks highly motivated individuals to work in Washington, DC, assisting with administering the Commissions Freedom of Information Act (FOIA) Program. The Program reviews and responds to all requests for records that the agency receives; and is available to provide litigation support to the agency as needed.

The incumbent will:

  • Determine whether requests complies with the requirements of FOIA, and the Commission’s Rules of Practice 16 C.F.R. § 4.11. Routinely negotiate with requesters concerning the scope of the request, fees associated with the request and possible extensions of time. Conduct an initial search of the Commission’s electronic databases (including, but not limited to, Consumer Sentinel, IDTheft, MMS, Intra/Internet and Landoc) to determine if there may be responsive records and to identify the offices that are likely to have such records. Gathers and compiles the responsive documents: either retrieving the records themselves or directing the search of staff in other divisions.
  • Primarily make all disclosure decisions consistent with agency policy and applicable FOIA Exemptions. Where the compliant was originally lodged with a federal law enforcement partner, the incumbent will contact the other federal agency and discuss the disclosure decision with that agency. Prepares a legal memorandum detailing the actions taken in fulfilling the request, the decisions made and substantiation thereof, and makes a recommendation to the lead FOIA attorney. Prepares a final letter responding to the requests to be signed by the lead FOIA attorney.
  •  Assists with the FOIA website development and content maintenance; responds to telephone inquiries from the public; reviews and collects current case law and executive guidance regarding FOIA; and assists in preparing the agency’s annual FOIA report to Congress. Works with ligation attorneys to address court or administrative discovery requests and other requests for agency records and assists with legal research and brief preparation. Assists with FOIA Appeals and Petitions to Quash.

You must have one year of specialized experience equivalent to the next lower grade in the Federal service, which has equipped you with the particular knowledge, skills, and abilities to successfully perform the duties of the position.

At the GS-7 level, applicants must have one year specialized experience equivalent to the GS-5 level in the Federal Service.

Specialized experience is defined as experience which is in or directly related to the line of work of the position to be filled and which has equipped the applicant with the particular knowledge, skills and abilities to perform successfully the duties of the position.

To be creditable, this experience must include knowledge of and experience with assisting in investigations and litigation of antitrust and consumer protection matters and conducting legal and relevant industry research and producing written and oral reports based on interviews, research and data analysis. OR, one (1) full year of graduate level education or Superior Academic Achievement (3.0 undergraduate GPA) may be substituted for experience requirements in accordance with Administrative and Management Qualifications Standard found at:
