The NSF is seeking qualified candidates for the position of an Assistant General Counsel within the Office of the Director (OD), Office of the General Counsel (OGC), Arlington, VA.
The OGC is the legal advisor and advocate for the Foundation, providing legal advice and assistance on all aspects of the Foundation's programs, policies, and operations, as well as areas affecting science and technology more broadly. Advice is provided in a wide variety of areas, such as: grants, contracts and cooperative agreements; intellectual property; conflicts-of-interest; employee and labor relations; civil rights; health, safety and environment; public regulation of research; Federal fiscal and administrative law and procedure; international law and agreements; and national security restrictions of scientific research (including export controls). The OGC also provides litigation expertise to the agency coordinating each phase of complex litigation with various divisions of the U.S. Department of Justice.

The individual selected for this position will serve as an Assistant General Counsel for Human Resources.The incumbent of this position should have experience in and knowledge of federal human resources laws, policies, procedures and precedents. The selected candidate will be responsible for providing legal advice and guidance regarding all aspects of federal human resources areas, including employee relations, labor relations, Equal Employment Opportunities (EEO), personnel, and employment law. Additionally, the Assistant General Counsel will:
- Counsel all levels of NSF management with respect to legal and policy aspects of employee relations, labor relations, personnel and employment law.
- Identify facts and issues to determine the nature of the legal problem, conduct legal research, and providewritten and oral legal advice.
- In disputed cases, prepare the Foundation's case and present it before the appropriate tribunal, which may be administrative, trial or appellate.
- Determine the approach after analysis of legal theories. Plan and conduct investigations. Weigh the evidence. Determine alternative legal strategies.
- Prepare proposed complaints and other legal documents such as trial briefs, subpoenas, motions, answers, depositions, proposed findings of fact and conclusions of law, and appeal briefs.
- Select and prepare witnesses. Examine and cross examine lay and expert witnesses.

Candidates must have a J.D. from a school of law accredited by the American Bar Association (ABA), plus after award of the J.D., eight or more years of professional legal experience providing legal advice and guidance on activities related to employee relations, labor relations, EEO, personnel, and employment law.
Qualified Candidates will have at least 8 years of experience providing legal advice and guidance in ALL of the following areas: employee relations, labor relations, EEO, personnel, and employment law.
Bar Membership: Member in good standing of the bar of a State, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
You will need to successfully complete a background security investigation before you can be appointed into this position.

- In-depth knowledge of and demonstrated practice in Federal labor and employment laws, including but not limited to, Title VII of the Civil Rights Act, the Rehabilitation Act, and the Federal Service Labor-Management Relations Statute.
- Ability to analyze legal problems, including consideration of applicable legal rules, the issues they present, the policy considerations that underlie them, and the legal and programmatic benefits and risks that arise from them.
- Ability to represent the Agency in administrative and judicial proceedings, including but not limited to the EEOC, the MSPB, and the FLRA, as well as interagency and executive branch meetings, and negotiations, as demonstrated by an ability to write and argue clearly, succinctly, and persuasively.
- Ability to manage a varied workload and work concurrently and collaboratively with other attorneys and staff.
- Ability to understand and effectively advocate on behalf of the National Science Foundation.
