This position is located in the Human Resources Office servicing Army and Air National Guard Military Technicians, Active Guard Reserve and may include State personnel.  Its primary purpose is to provide comprehensive labor relations, adverse action and disciplinary services.  Accomplishes some of the work through the use of an automated personnel system.

 

-The position is responsible for labor contract negotiations and administration.  

 

-Develops and represents the state's position in administrative proceedings such as unfair labor practices, grievance proceedings, impasses and arbitrations.

 

-Serves as point of contact to union representatives, NGB, and management on labor relation's problems.

 

-Obtains from other sources Alternate Dispute Resolution services and advice or other non-adversarial problem solving approaches such as advocacy, mediation, interest-based bargaining, etc., for a variety of personnel problems encountered by management and employees.

 

-Advises the organization on issues that are sensitive, serious, or controversial.  

 

-Provides continuing advice to supervisors and management representatives on the variety of formal and informal methods available to assist them in carrying out their supervisory responsibilities.

 

-May facilitate development and administration of labor management partnership.  May organize and administer joint labor management training.

 

-May accumulate and record actual use of official time by management and union personnel.

 

-May plan and assign work and provide guidance and technical assistance to an assistant.

 

-Performs other duties as assigned.

In order to meet the minimum qualifications for this  HUMAN RESOURCES SPECIALIST (LABOR RELATIONS) position, you must meet the following criteria.

 

GENERAL EXPERIENCE: 

Experience, education or training which involves the exercise of analytical ability, judgment, discretion, and personal responsibility, and application of a substantial body of knowledge of principles, concepts and practices applicable to one or more fields of administration or management.  Experience using computer and automation systems.

 

SPECIALIZED EXPERIENCE:

Must have at least 36 months experience, education, or training involving the administering, delivering, maintaining, advising, and adapting advanced concepts, principles, and theories of Human Resources to the unique organizational, management, and mission requirements.  Experience assisting in the development of Human Resources policies and procedures.  Experience advising management on Human Resources principles and practices.

 

SUBSTITUTION OF EDUCATION FOR SPECIALIZED EXPERIENCE: 

Successful completion of a full 4-year course of study in any field leading to a bachelor's degree, in an accredited college or university, meets the GS-5 level requirements.

 

KSA's:

Candidates will be evaluated on the basis of the KSA's listed below.   Applicants are encouraged to address the KSA's in their application or resume or by submitting a supplemental statement with their application.   Written response to each KSA will ensure that specialized experience criteria is recognized and credited.

 

1.  Knowledge of legal research methods, information gathering techniques.

2.  Knowledge of, and skill in applying, a full range of labor relations theories, principles, methods, precedents, case law and negotiation processes and strategies to serve as the technical authority on all aspects of the state labor relations program to provide comprehensive management advisory services and to negotiate agreements between management and labor unions.

3.  Analytical skill sufficient to locate, interpret, and analyze for applicability and appropriateness, precedent and substantive decisions and/or legal opinions that various courts and administrative bodies have rendered.

4.  Skill in negotiation procedures and techniques, advocacy, mediation, interest-based bargaining, and other non-adversarial problem solving approaches sufficient to resolve problems and advise management.  Conflict resolution techniques sufficient to interact in occasionally highly charged emotional situations must also be utilized.  These issues may be delicate or highly contested case matters and determinations.

5.  Skill in communication techniques sufficient to formulate and present arguments and advisory opinions and to prepare legal and case documents.

6.  Knowledge and understanding of procedures in both programs to provide proper advice and guidance

HOW YOU WILL BE EVALUATED:

All qualified applicants will be forwarded to the selecting official, unless there are more than seven qualified applicants.  In this case, the evaluation procedures in DMNA PAM 690-4, Chapter 5 will be used to further screen candidates prior to referral.  A panel of three members will be appointed to rate the candidates using the KSA factors.  Experience will be evaluated in terms of type and quality in relation to the requirements of the position.  Length of service or experience will only be used when there is a clear relationship with quality of performance or when necessary to break ties when all other ratings are equal. 

 

Following the determination of basic eligibility of the candidates as outlined in DMNA PAM 690-4, Chapter 5, qualified applicants will be referred to the selection official in the following sequence: 

 

1.  Category I:  All excepted service technicians in the New York Army National Guard  for Army technician vacancies and all excepted service technicians in the New York Air National Guard for Air technician vacancies, working at the location specified in the job announcement where the vacancy exists.

 

2.  Category II:  All currently employed excepted service technicians in either the New York Army or New York Air National Guard. 

 

3.  Category III:  Qualified members of the New York National Guard (Army or Air), to include AGR personnel and temporary and Indefinite technicians, or other individuals who are willing to become members of the New York Army or Air National Guard. 

 

* If there are fewer than three qualified applicants in Category I, then qualified applicants from Category II, III will be forwarded to the selection official, in sequential order, to provide at least three qualified applicants.
