Position Summary:  To provide Intellectual Property and Technology Transfer legal advice and services, including: conducting legal and scientific research; preparing and prosecuting patent applications; advising and assisting Air Force and contractor employees on rights in inventions, patents, copyrights, trademarks, trade secrets, technical data and computer software; and negotiating and preparing licenses, assignments, cooperative research and development agreements, education partnership agreements, commercial test agreements, nondisclosure agreements and other instruments for the transfer of Air Force technology.

Applicants must meet all of the following:

·         Have a first professional law degree (LL.B. or J.D.) that is accredited by the American Bar Association;

·         Active membership in good standing in the Bar or highest court of a state, or U.S. territory, U.S. commonwealth or District of Columbia;

·         Never been disciplined, sanctioned, or had fitness to practice law challenged by any bar or court or a state or territory of the U.S. or District of Columbia,

-      Registered to practice as an attorney with the United States Patent and Trademark Office (USPTO). 


·         Professional legal experience in excess of three years commensurate with the duties and responsibilities of the position to be assumed. This experience must be professional legal experience in patent law related activities such as; preparation, filing, and prosecution of patent and trademark applications; advising and assisting officials on Technology Transfer and Intellectual Property law; negotiating and preparing Technology Transfer and related agreements; and docket management of inventions and Technology Transfer agreements.

IMPORTANT: You must provide supporting documentation: Current Bar Membership and current official certification of your fitness to practice law. All certifications must be dated no more than 120 days prior to submitting the application. (In most states, you can obtain this certification, usually referred to as a Certificate of Good Standing, from The Supreme Court, Office of Attorney Services). Additionally, if you have been a bar member for less than five years, a copy of your final law school transcript and, if available, a statement of relative class standing is required. Failure to submit all of the proper documentation will result in removal of your application from consideration.

PART-TIME OR UNPAID EXPERIENCE: Credit will be given for appropriate unpaid work on the same basis as for paid experience. Part-time experience will be credited on the basis of time actually spent in appropriate activities. To receive credit for such experience you must indicate clearly the nature of the duties and responsibilities in each position held and the number of hours per week spent in such employment.   

Only experience obtained by the closing date of this announcement will be considered.

KNOWLEDGE, SKILLS AND ABILITIES (KSAs):  Your qualifications will be evaluated on the basis of your level of knowledge, skills, abilities and/or competencies in the following areas:


Knowledge, skill, and ability of chemistry and Chemical Engineering, as well as general science, engineering and mathematics.

Knowledge, skill and ability of general Intellectual Property law and practice, such as copyright, trademark, trade secret and licensing, for example.

Knowledge, skill and ability of patent preparation and prosecution, including prior art searching, scientific and legal research, interviewing inventors and examiners and USPTO practice and procedure.

Knowledge, skill and ability of Technology Transfer law and practice, including preparation and negotiation of Technology Transfer agreements.

Knowledge, skill and ability of legal research and the general practice of law, including clear and trenchant interpretation and application of law, regulation and policy to specific factual situations.

Knowledge, skill and ability of clear and effective scientific, legal and general communication, including public speaking and writing.

Knowledge, skill and ability of effectively and independently working with computers, office and administrative equipment and software and the internet.

Knowledge, skill and ability of working effectively and professionally with a variety of individuals having different backgrounds, education, and interests.

Knowledge, skill and ability of effective negotiation with others over issues of competing interests.

Maintenance of a current license as an attorney and counselor at law in a state or territory of the United States, the District of Columbia,  or the Commonwealth of Puerto Rico.



THIS POSITION REQUIRES SPECIFIC EDUCATION TO QUALIFY: If you have been a member of the bar for less than 5 years, you MUST provide your law school transcripts.  If you are selected, you must provide original transcripts prior to appointment.  Education must be accredited by an accrediting institution recognized by the U.S. Department of Education.

Incumbent is required to obtain and maintain an appropriate security and program clearance necessary to execute the duties of this position.

This may be a Testing Designated Position. You may be subject to pre-employment drug testing and participation in random drug testing as a condition of employment.  

Incumbent is required to maintain Continuing Legal Education (CLE) currency as established by incumbent bar.  

This is an Excepted Service appointment. The appointment made under the provisions of this announcement is excepted from competitive civil service and may require the incumbent serve a trial period. An applicant receiving such an appointment does not acquire competitive civil service status.  

Incumbent is required to maintain current knowledge of changing statutory and regulatory guidance as they relate to the duties of this position, as well as general developments in technology that may improve the effective delivery of legal services. 

Incumbent must be currently licensed as an attorney and counselor-at-law in a state or territory of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. 

Work may occasionally require travel away from the normal duty station by private vehicle or on military or commercial aircraft.

Incumbent is required to submit an initial and annual OGE-450 (Confidential Financial Disclosure Report) in accordance with the Joint Ethics Regulation.

Incumbent must be currently registered to practice as an attorney with the United States Patent and Trademark Office.

A Bachelors Degree from an accredited college or university relevant to Chemical Engineering is highly desired.



BASIS OF RATING: No written examination will be required.  Applicants will be rated on the content of the application, considering education, experience and other professional qualifications; that the best qualified applicants will be given an oral interview to further evaluate suitability and knowledge of the law; that final selection is a two-part process comprised of: (1) rating by the local civilian attorney committee (including results of the oral interview); and (2) final review of qualifications of the best qualified applicants by the qualifying authority including, in its discretion, another oral interview; and that final selection is subject to approval of the qualifying authority which may revise the rank order of preference of selection.

There is no formal rating system for applying veterans' preference to attorney appointments in the excepted service; however, the Department of Defense considers veterans' preference eligibility a positive factor for attorney hiring.   Applicants eligible for veterans' preference must include that information in their cover letter or resume and attach supporting documentation (e.g., DD Form 214, "Certificate of Release or Discharge from Active Duty") to their submissions.
