Serves as the Employee Relations/Labor Relations (ER/LR) supervisor for the Southwest Region Human Resources Office which serves the Phoenix Area IHS and Tucson Area IHS:

  • Responsible for a region-wide ER/LR program that provides professional support for management to resolve complex issues.
  • Supervise a group of employees performing technical ER/LR work and provides administrative and technical supervision.
  • Serve as senior technical advisor on all issues relating to employment law (i.e., wage and hour standards, discrimination, workplace safety and health, pensions and benefits, worker's compensation, etc.) and labor law (i.e., union-management relations, collective bargaining, unfair labor practices, etc.).  This includes determining the degree of regulatory compliance and procedural accuracy of ER/LR program requirements and reviewing relevant ER/LR decisions and rulings for impact on a Federal agency.
  • Represent the agency in all employment and labor relations legal cases which include third-party proceedings before the Federal Labor Relations Authority (FLRA), the Merit Systems Protection Board (MSPB), Equal Employment Opportunity Commission (EEOC), and other Federal organizations.

In order to be considered, applicants must both of the requirements listed below:

1. SELECTIVE PLACEMENT FACTOR

Skill in representing a Federal agency in all employment or labor relations legal cases which includes third party representational activity.  Examples of this may include:

  • Conduct administrative hearings before the Merit Systems Protection Board (MSPB); or
  • Work with opposing legal counsel, general and/or investigative attorneys, and Administrative Law Judges on labor law cases; or
  • Negotiate settlement agreements before the Federal Labor Relations Authority (FLRA); or
  • Conduct alternative dispute resolution involving arbitration between unions and the agency; or
  • Represent management in hearings before the Federal Service Impasses Panel (FSIP).

Failure to meet this selective factor will result in loss of consideration.


2. ADDITIONAL REQUIREMENTS FOR THE GS-13 LEVEL

You may be considered for this grade level if you have 1-year of specialized experience equivalent to the GS-12 level applying a wide range of employee relations and labor relations policies and practices to perform detailed analyses and draw conclusions on complex legal issues.  A background in employment and/or labor law is highly desirable.  Examples may include:

  • Use legal research methods, information-gathering techniques, and analytical skill sufficient to locate, interpret, and analyze for applicability and appropriateness, precedent and substantive decisions, and/or legal opinions that various courts and administrative bodies have rendered;
  • Apply negotiation procedures and techniques, advocacy, mediation, interest-base bargaining, and other non-adversarial problem solving approaches sufficient to resolve problems and advise management;
  • Employ conflict resolution techniques sufficient to interact in occasional highly charged emotional situations because of delicate or highly contested case matters and determinations; and
  • Use oral and written communication techniques sufficient to formulate and present arguments and advisory opinions and to prepare legal and case documents.
  • Prior leadership and/or supervisory experience for a ER/LR staff is highly desirable.

Time-In-Grade Requirement:  Federal employees must have completed at least one year of service in a position no more than two grade lower (GS-12) than the position to be filled.

HOW YOU WILL BE EVALUATED:

We will review your application to ensure you meet the qualification requirements. Applicants will be rated on the following skills or competencies: employee relations, labor relations, customer service, and supervision.

If found qualified your score will range from 70-100 points (not including points that may be assigned for Veteran’s Preference). We will compare your resume and supporting documents to your responses on the assessment questionnaire. You will be deemed well qualified if you score 85 and above.
