The U.S. Trustee Program (USTP) is a litigating component of the Department of Justice and has the legal authority to appear in every bankruptcy case filed in the United States, from Title 28 Chapter 7 liquidations to major Chapter 11 business reorganizations. As a result, USTP employees headquartered in Washington, D.C., and in our 95 field offices throughout the country handle a wide range of challenging and significant matters as we strive to promote the integrity of the bankruptcy system by enforcing bankruptcy laws. Of particular importance is this Program's effort to address fraud and abuse by debtors, creditors, attorneys, and others in the bankruptcy system by taking formal and informal actions in a civil context and making criminal referrals to and working with the U.S. Attorneys. Serve as a Legal Assistant responsible for directly and independently supporting one or more professional staff members engaged in the administration of bankruptcy cases.  The work requires a specialized knowledge of the processes, procedures, and practices of bankruptcy.  Some of the typical work assignments may include:

• Examines, prepares and processes legal documents associated with Chapters 7, 11, and 13 cases, reviews incoming material and independently determines the need for assembly and preparation of a variety of legal documents;
• Assigns Chapter 7 no-asset cases to panel trustees, prepares trustee appointment notices, bonding certificates, and other file documents required to administer the debtor’s estate;
• Verifies citations and statutory references contained in legal documents;
• Maintains case files, advises staff members of significant events that may alter the legal status of a case;
• Provides a variety of direct clerical and administrative support assistance services, e.g. opens and distributes mail; orders, controls, and distributes recordings of meetings; maintains law library; orders supplies and equipment; processes time and attendance records; and maintains administrative files.
• Produces a variety of written documents and materials utilizing a wide range of office software applications; and
• Performs other related duties as assigned.

SELECTIVE PLACEMENT FACTOR:  Selective Placement Factors are part of the minimum requirements for a position, and applicants who do not meet it are ineligible for further consideration.


The Selective Placement Factor identified for this position is as follows:  At least six (6) months bankruptcy experience is required which exhibits knowledge of bankruptcy regulations and procedures. Education cannot be substituted for the six months bankruptcy experience requirement.


Qualifications Required:

Applicants must have one year of specialized experience equivalent to the next lower grade level in the Federal service.  Specialized experience is progressively responsible legal experience that equipped the applicant with the particular knowledge, skills, and abilities to perform successfully the duties of the position as described above, and that is typically in or related to the position to be filled.


GS-6 level:  Applicants must have one year of specialized experience equivalent to the GS-5 level.  Specialized experience is defined as:  Experience receiving and reviewing bankruptcy petitions and related documents for proper form and timeliness; Experience typing pleadings, motions, and other legal documents from rough draft and/or finalizing documents into final format; Experience entering data from bankruptcy petitions, schedules, and office records into a database.
GS-7 level:  Applicants must have one year of specialized experience equivalent to the GS-6 level.  Specialized experience is defined as:  Experience reviewing bankruptcy petitions and schedules for conformance with legal and judicial requirements; Experience preparing legal documents such as trustee appointment notice, bonding certificate, section 341 (a) meeting notices, and any other documents needed to administer the debtor's estate; Experience maintaining bankruptcy case files to ensure all documents and correspondence necessary to reflect the current status of the case are available to the attorneys.

Proficiency Requirement: Applicant must be able to type 40 words per minute. (Applicants who do not meet it are ineligible for further consideration)

SUBSTITUTION OF EDUCATION FOR EXPERIENCE:  Education may not be substituted for the one year of specialized experience.
