POSITION LOCATION:  Human Resources Office, Joint Force Headquarters, New Mexico Army National Guard, Santa Fe, New Mexico.

POSITION DESCRIPTION:  D1033000.

POSITION POTENTIAL:  The top grade of this position is GS-11.  This position is also being advertised at the GS-07 and GS-09 level(s) to provide additional competition.  Upon meeting all legal and regulatory requirements, and upon recommendation of the supervisor, an individual selected at the GS-07 or GS-09 level may be promoted to the target grade of GS-11 level without further competition.

LOWEST PAY GRADE ACCEPTED:  Applicants must indicate on their application the lowest pay or grade that will be accepted.

The purpose of this position is to provide comprehensive labor relations, adverse action, disciplinary services, and employee relations case management services related to conduct, performance, attendance, and dispute resolution. Accomplishes some of the work through the use of an automated personnel system. Provides management advisory services concerning labor and management relations issues arising from decisions involving Human Resources issues Evaluates and monitors the effectiveness of employee-employer relationships, which contribute to productivity, motivation, morale and discipline. Responsible for labor contract negotiations and administration. These may include multiple contracts and multiple bargaining units. Consults with all levels of management to include The Adjutant General, Assistant Adjutant General, Chief of Staff, Air Commander, Air National Guard (ANG) Group Commanders, and Army National Guard (ARNG) directorate technicians, to develop state policies on and positions for negotiation to include researching impact of potential union proposals. Develops and represents the state's position in administrative proceedings such as unfair labor practices, grievance proceedings, impasses and arbitrations. Conducts investigations and consults with National Guard Bureau (NGB) Labor Management Division to keep them informed of the issues involved. Prepares briefs, position papers, etc., and assists witnesses in preparing testimony. Serves as point of contact to union representatives, NGB, and management on labor relations’ problems. Obtains from other sources, Alternate Dispute Resolution services and advice or other non-adversarial problem solving approaches such as advocacy, mediation, interest-based bargaining, etc., for a variety of personnel problems encountered by management and employees. Resolutions offered may be non-binding but are to be in the best interest of the National Guard.

BASIC QUALIFICATION REQUIREMENTS:  The basic qualification requirements are indicated below.  These qualification requirements must be met, in addition to any military requirements, in order to be found qualified for and selected to this position.

GENERAL EXPERIENCE:  Experience, education or training which involves the exercise of analytical ability, judgment, discretion, and personal responsibility, and application of a substantial body of knowledge of principles, concepts and practices applicable to one or more fields of administration or management and experience using computer automation systems.

SPECIALIZED EXPERIENCE (Prepare written justification to the following KSAs as an attachment to your resume/application):

1. Knowledge of legal research methods and information gathering techniques.

2. Knowledge of and skill in applying the full range of labor and employee relations theories, principles, practices and regulations sufficient to perform detailed analyses and draw conclusions on complex legal issues, problems, and situations, provide advisory service to management about appropriate disciplinary and other corrective techniques that are responsive to a range of conduct and performance problems. Utilizes legal research methods, information gathering techniques.

3. Knowledge and skill sufficient to locate, interpret and analyze for applicability and appropriateness, precedent and substantive decisions and/or legal opinions that various courts and administrative bodies have rendered.

4. Skill in negotiation procedures and techniques, advocacy, mediation, interest-based bargaining and other non-adversarial problem solving approaches sufficient to resolve problems and advise management. Conflict resolution techniques sufficient to interact in occasionally highly charged emotional situations must also be utilized. These issues may be delicate or highly contested case matters and determinations.

5. Skill in communication techniques sufficient to formulate and present arguments and advisory opinions and to prepare legal and case documents.

QUALITY AND TYPE OF EXPERIENCE:  The required amount of experience/education will not in itself be accepted as proof of qualification.  The quality, type and scope of the experience/education must be of such nature as to demonstrate that applicants are fully qualified to perform the duties at the level for which they apply.

DOCUMENTATION:  Applicants must explain in detail, in the application, how the specialized experience was acquired, including applicable dates.  Applicants should include, with application, any training completion certificates/transcripts in the areas covered in the KSAs.

EDUCATION SUBSTITUTE:  Military education, related to the position, may be substituted for specialized experience on a day-for-day basis for qualification at the GS-07 or GS-09 level(s).  Certificates/diplomas must be submitted with application for award of credit.  Civilian education, above the high school level, may be substituted for specialized experience on a case-by-case basis.  Transcripts or equivalent must be submitted for award of credit.

APPOINTMENT REQUIREMENTS:  Excepted Civil Service.  Individual selected must be assigned to a commissioned officer, warrant officer or enlisted position in the New Mexico Army or Air National Guard.  Individual must wear the uniform as prescribed by National Guard Bureau policies and the Adjutant General of New Mexico.  Employment is contingent upon successful completion of a pre placement physical examination.

EVALUATION METHOD:  All applicants will be initially screened against mandatory qualifications.  If more than ten applicants are qualified, applicants will be evaluated on the basis of relevant experience, training and education, awards, and performance appraisals to determine the ten best qualified.  Rating and ranking to determine best qualified will be conducted by a panel of representative who have technical expertise in the career field of the position being filled and a staff representative of the Human Resources Office.  The evaluation will be based on the knowledge, skills, and abilities (KSAs) considered necessary for successful performance in the position.  Once the application process is complete, a review of your application will be made to ensure you meet the job requirements.
